Recalls that the level of transparency of the negotiations as well as many provisions of ACTA itself, have been a cause of controversy that this Parliament has dealt with repeatedly during all stages of the negotiation; underlines that in line with Article 218(10) of the Treaty on the Functioning of the European Union (TFEU) Parliament must be immediately and fully informed at all stages of the procedure; takes the view that adequate transparency has not been ensured throughout the negotiations on ACTA; recognises that efforts to inform Parliament have been undertaken by the Commission,but regrets that the requirement of transparency has been construed very narrowly and only as a result of pressure by Parliament and civil society; emphasises that in line with the Vienna Convention on the Law of Treaties when interpreting a treaty '[r]ecourse may be had to supplementary means of interpretation, including the preparatory work of the treaty and the circumstances of its conclusion' (Article 32); points out that not all of the preparatory work for ACTA is publicly available;

68. souligne qu'il entend continuer à participer activement aux travaux organisés par la Commission dans le cadre du suivi de sa communication précitée sur la réponse de l'UE aux situations de fragilité; attire l'attention du Conseil et de la Commission sur le fait qu'il est désormais urgent que ces travaux, trop lents, puissent déboucher rapidement sur des actions concrètes à mettre en œuvre sur le terrain dans des domaines aussi essentiels que la santé et l'éducation, et invite la Commission à tenir le Parlement pleinement informé des mesures complémentaires prises au vu des conclusions des études menées dans les pays choisis et notamment en mettant à profit les résultats obtenus aux fins de la sélection et de la mise en place des actions futures;

Intends to continue to take an active part in the work organised by the Commission as part of the follow-up to its above-mentioned communication on the EU response to situations of fragility; draws the attention of the Council and Commission to the fact that it is now urgent that this work, which has been too slow, might swiftly lead to concrete actions to be taken on the ground in such key areas as health and education, and calls on the Commission to keep European Parliament fully informed of further steps undertaken with regard to the conclusions of country case studies and particularly in terms of the use of these findings for the identification and design of subsequent actions;
