4. estime qu'au vu des caractéristiques particulières du sport, la Commission doit envisager, après consultation des parties concernées et du Parlement, d'adopter une interprétation afin de clarifier l'ensemble de la question du rapport entre le droit communautaire et les "règles sportives" qui ne ressortissent pas à ce droit et les secteurs dans lesquels s'applique le droit communautaire, notamment pour ce qui est de la démarcation entre les aspects liés à l'organisation qui relèvent de ce droit, et les règles qui n'en relèvent pas, en tenant compte aussi des principes de subsidiarité et de proportionnalité et du fait que les règles sportives qui ne portent que sur des questions purement sportives et, partant, n'ayant aucun rapport avec l'activité économique, n'entrent pas dans le champ d'application du traité; estime que, pour établir cette démarcation, il convient de tenir compte de la distinction entre sport professionnel et sport amateur; souligne que ces règles, qui ont trait au caractère et au contexte particuliers des événements sportifs, régissent l'organisation et le bon déroulement des compétitions sportives et ne sauraient être considérées comme des entraves aux règles communautaires en matière de libre circulation des travailleurs et de liberté de prestations de services, à condition que les effets restrictifs sur la concurrence soient proportionnels à l'intérêt sportif authentique et légitime qui est recherché;
4. Considers that, in view of the unique characteristics of sport, the Commission should consider, after consulting the various interests concerned and Parliament, the adoption of interpretative guidelines designed to clarify the whole question of the relationship between Community law and "sporting rules" that do not fall within the remit of that law and the area to which that law applies, in particular the demarcation between those aspects of the organisation of sport which are subject to that law and those rules which are not, having regard also to the principles of subsidiarity and proportionality, and bearing in mind that sporting rules concerning questions of purely sporting interest and having as such nothing to do with economic activity do not fall within the scope of the Treaty; considers that this demarcation should take account of the distinction between professional and amateur sports; points out that such rules, which relate to the particular nature and context of sporting events, are inherent in the organisation and proper conduct of sporting competition and cannot be regarded as constituting a restriction on the Community rules on free movement of workers and freedom to provide services, provided that the restrictive effects on competition are proportionate to the legitimate genuine sporting interest pursued;

La Commission pourrait-elle indiquer si la législation irlandaise relative au versement des indemnités de licenciement, laquelle stipule qu'un travailleur licencié avant l'âge normal de la retraite peut uniquement prétendre à une indemnité réglementaire limitée au montant correspondant à la rémunération qu'il aurait pu percevoir entre son licenciement et l'âge normal de son départ en retraite (par exemple, un travailleur licencié six mois avant sa retraite ne pourrait réclamer qu'une prime de licenciement correspondant à six mois de salaire) est compatible avec le droit communautaire, notamment avec la directive sur l'insolvabilité (2002/74/CE) et avec la directive sur les licenciements collectifs (98/59/EC)?
Could the Commission indicate whether Ireland's Redundancy Payments Act, which provides that a worker who is made redundant before the normal retirement age may only claim statutory redundancy limited to an amount not exceeding the amount he/she could have earned between redundancy and the normal date for his/her retirement (e.g. a worker made redundant six months before retirement could only claim redundancy compensation of six months wages), is compatible with EC law, including the Insolvency Directive (2002/74/EC ) and the Collective Redundancies Directive (98/59/EC)?

Sans préjudice des dispositions nationales et communautaires relatives à l’information et à la consultation, plus contraignantes ou plus spécifiques, et notamment de la directive 2002/14/CE du Parlement européen et du Conseil du 11 mars 2002 établissant un cadre général relatif à l’information et la consultation des travailleurs dans la Communauté européenne , l’entreprise utilisatrice doit fournir des informations appropriées sur le recours aux travailleurs intérimaires en son sein lors de la transmission d’informations sur la situation de l’emploi dans l’entreprise aux instances représentatives des travailleurs instituées conformément à la législation communautaire et nationale.
Without prejudice to national and Community provisions on information and consultation which are more stringent and/or more specific and, in particular, Directive 2002/14/EC of the European Parliament and of the Council of 11 March 2002 establishing a general framework for informing and consulting employees in the European Community , the user undertaking must provide suitable information on the use of temporary agency workers when providing information on the employment situation in that undertaking to bodies representing workers set up in accordance with national and Community legislation.

La Commission voudrait attirer l'attention de l'honorable parlementaire sur le fait que le droit communautaire - notamment, les règlements 1408/71 et 574/72 - protège les droits des travailleurs migrants en matière de sécurité sociale par le biais de la coordination des différents régimes nationaux de sécurité sociale en vigueur dans les États membres.

The disclosure of information to and the consultation of representatives of the employees of the offeror and the offeree company should be governed by the relevant national provisions, in particular those adopted pursuant to Council Directive 94/45/EC of 22 September 1994 on the establishment of a European Works Council or a procedure in Community-scale undertakings and Community-scale groups of undertakings for the purposes of informing and consulting employees , Council Directive 98/59/EC of 20 July 1998 on the approximation of the laws of the Member States relating to collective redundancies , Council Directive 2001/86/EC of 8 October 2001 supplementing the statute for a European Company with regard to the involvement of employees and Directive 2002/14/EC of the European Parliament and of the Council of 11 March 2002 establishing a general framework for informing and consulting employees in the European Community — Joint declaration of the European Parliament, the Council and the Commission on employee representation .
