2 (1) Sous réserve des autres dispositions du présent article, les dispositions de la convention figurant à l’annexe I et celles de la convention figurant à l’annexe V, dans la mesure où elles se rapportent aux droits et responsabilités des personnes concernées par le transport aérien — notamment les transporteurs et leurs préposés, les voyageurs, les consignateurs et les consignataires —, ont force de loi au Canada relativement au transport aérien visé par ces dispositions, indépendamment de la nationalité de l’aéronef en cause.
2 (1) Subject to this section, the provisions of the Convention set out in Schedule I and of the Convention set out in Schedule V, in so far as they relate to the rights and liabilities of carriers, carriers’ servants and agents, passengers, consignors, consignees and other persons, have the force of law in Canada in relation to any carriage by air to which the provisions apply, irrespective of the nationality of the aircraft performing that carriage.

L'avis d'ouverture de la procédure annonce l'ouverture d'une enquête, indique le domaine couvert par l'enquête, les services de transport aériens visés sur les routes concernées, les pays dont les pouvoirs publics ont prétendument octroyé les subventions ou accordé une licence aux transporteurs aériens mettant prétendument en oeuvre des pratiques tarifaires déloyales ainsi que le délai dans lequel les parties intéressées peuvent se faire connaître, présenter leur point de vue par écrit et fournir des renseignements, si ces arguments doivent être pris en compte au cours de l'enquête. L'avis précise également le délai dans lequel les parties intéressées peuvent demander à être entendues par la Commission.
3. The notice of initiation of the proceedings shall announce the initiation of an investigation, indicate the scope of the investigation, the air services on the routes concerned, the countries whose governments allegedly granted the subsidies or license the air carriers allegedly engaged in unfair pricing practices and the period within which interested parties may make themselves known, present their views in writing and submit information, if such views are to be taken into account during the investigation; the notice shall also state the period within which interested parties may apply to be heard by the Commission.

Notwithstanding the horizontal adaptation provided in the first indent of the Annex to the Agreement between the European Community and the Swiss Confederation on Air transport, the references to the “Member States” made in Article 5 of Regulation (EC) No 549/2004 or in the provisions of Decision 1999/468/EC mentioned in that provision shall not be understood to apply to Switzerland’.

(4) La réglementation communautaire, et notamment les règlements du Conseil (CEE) n° 3975/87 du 14 décembre 1987 déterminant les modalités d'application des règles de concurrence applicables aux entreprises de transports aériens(6) et (CEE) n° 3976/87 du 14 décembre 1987 concernant l'application de l'article 85, paragraphe 3, du traité à des catégories d'accords et de pratiques concertées dans le domaine des transports aériens(7), vise à introduire plus de concurrence entre les entités fournissant des services de transport aérien au public.
(4) Community legislation, and in particular Council Regulation (EEC) No 3975/87 of 14 December 1987 laying down the procedure for the application of the rules on competition to undertakings in the air transport sector(6) and Regulation (EEC) No 3976/87 of 14 December 1987 on the application of Article 85(3) of the Treaty to certain categories of agreements and concerted practices in the air transport sector(7), is designed to introduce more competition between carriers providing air transport services to the public.

Dans la perspective de l'arrivée à échéance du règlement (CEE) n° 1617/93, la Commission a procédé à des examens approfondis pour vérifier dans quelle mesure elle devait continuer d'exempter les quatre domaines des transports aériens visés par ce règlement (consultations tarifaires pour le transport de passagers, répartition des créneaux horaires dans les aéroports, planification conjointe et coordination des horaires des compagnies aériennes, et exploitation de services en commun).
In view of the expiry of Regulation (EEC) No 1617/93 the Commission initiated extensive investigations with the aim of verifying to what extent it should continue exempting the four subject matters of air transport covered by this Regulation (i.e. passenger tariff consultations; slot allocation at airports; joint planning and coordination of airline schedules; and joint operations).
