Dans le cadre de la politique commune des transports, il importe de sauvegarder les droits des voyageurs ferroviaires et d’améliorer la qualité et l’efficacité des services ferroviaires de voyageurs afin d’aider à accroître la part du transport ferroviaire par rapport aux autres modes de transport.
In the framework of the common transport policy, it is important to safeguard users’ rights for rail passengers and to improve the quality and effectiveness of rail passenger services in order to help increase the share of rail transport in relation to other modes of transport.

Strengthening of the rights of rail passengers should build on the existing system of international law on this subject contained in Appendix A — Uniform rules concerning the Contract for International Carriage of Passengers and Luggage by Rail (CIV) to the Convention concerning International Carriage by Rail (COTIF) of 9 May 1980, as modified by the Protocol for the modification of the Convention concerning International Carriage by Rail of 3 June 1999 (1999 Protocol).

This prevalence of liability of the railway operator is in line with international conventions, in particular Article 1 (3) of the Uniform Rules concerning the Contract of International Carriage of Passengers by Rail (CIV - Appendix A to the Convention), the "Vilnius Protocol 1999", and Article 2 (2) of the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea 2002.

The Convention concerning International Carriage by Rail (COTIF) of 9 May 1980 currently in force includes Uniform Rules concerning the Contract for International Carriage of Passengers and Luggage by Rail, the CIV appendix. These provisions have been agreed by the States that are members of the Intergovernmental Organisation for International Carriage by Rail (OTIF).

The issues identified in this document were related to the general provisions and conditions of transport concerning international rail passenger journeys; passengers' rights before, during and after the journey as well as the obligations passengers have to comply with whilst travelling on an international service.
