6. Les articles 8, 10, 18 et 21 ne s’appliquent pas aux marchés réglementés, aux opérateurs de marché ni aux entreprises d’investissement dans le cadre de transactions dont la contrepartie est membre du Système européen de banques centrales (SEBC) et si la transaction en question est menée au titre de la politique monétaire, de change ou de stabilité financière que ce membre du SEBC est légalement habilité à poursuivre et si ledit membre a notifié au préalable à sa contrepartie que la transaction donne lieu à dérogation.
6. Articles 8, 10, 18 and 21 shall not apply to regulated markets, market operators and investment firms in respect of a transaction where the counterparty is a member of the European System of Central Banks (ESCB) and where that transaction is entered into in performance of monetary, foreign exchange and financial stability policy which that member of the ESCB is legally empowered to pursue and where that member has given prior notification to its counterparty that the transaction is exempt.

It concerns all financial transactions, namely the purchase and sale of a financial instrument, such as company shares, bonds, money-market instruments, units of undertakings for collective investment, structured products and derivatives and the conclusion or modification of derivatives agreements, on condition that at least one party to the transaction is established in a Member State and that a financial institution (such as investment firms, organised markets, credit institutions, insurance and reinsurance undertakings, collective investment undertakings and their managers, pension funds and their managers, and certain other undertakings where transactions constitute a significant part of their activity) established in a Member State is party to the transaction, acting either for its own account or for the account of another person, or is acting in the name of a party to the transaction.
