(Return tabled) Question No. 148 Ms. Megan Leslie: With regard to fast-start climate change commitments made by the government in the 2009 Copenhagen Accord: (a) what analysis does or has the government used to analyze the results of funded projects; (b) when will the government announce its financial plans for fulfilling climate change mitigation and adaptation commitments to developing countries past the 2012-2013 fiscal year; (c) what are the conditions necessary for the government to renew its contribution of public funding in support of the 2020 goal, committed to under the Copenhagen Accord, to mobilize up to $100 billion per year in financing by 2020; (d) what public funds will the government commit to fulfill its climate finance pledges between the fiscal year 2012-2013 and 2020-2021, broken down by year; (e) broken down by year, (i) what amount (in Canadian dollars) and what percentage of the funds referred to in (d) will be delivered as loans, (ii) what amount (in Canadian dollars) and what percentage of these funds will be delivered as grants; (f) has the government done any analysis of the social and economic impacts and benefits of loans versus grants for recipients; (g) what will be the percentage of funds allocated to mitigation, compared to funds allocated to adaptation to climate change, between the fiscal years 2012-2013 and 2020-2021; (h) how will future climate change mitigation and adaptation financing meet the requirements for Canadian official development assistance under the Official Development Assistance Accountability Act, namely with respect to poverty reduction, taking account of the perspectives of the poor, and the promotion of human rights; and (i) with respect to future climate finance funding delivered as loans or grants to multilateral banks, how will the government ensure that projects receiving funds meet the required aid effectiveness principles?

(Return tabled) Question No. 281 Ms. Jean Crowder: With regard to the British Columbia Treaty Process: (a) what substantive actions has the government taken to study the issue of accumulation of interest from treaty loans; (b) how does the debt from this interest affect the treaty negotiations; (c) when will the government outline its new approach to funding for First Nations self-government as announced in the March 2010 budget; (d) how has the federal mandate on negotiation changed since 2006; (e) how many treaty loans will come due in 2012; (f) what is the total value of those treaty loans coming due in 2012; (g) what is the total value of interest on those loans; (h) what steps has the government taken to extend the deadline on treaty loans; (i) when will the government report to the House of Commons on the treaty loan deadline; and (j) what is the communications plan for First Nations regarding the treaty loan deadline, including those First Nations involved in treaty negotiations, those that have dropped out of the process and those that are not involved in treaty negotiations?

In the event of ESM financial assistance in the form of ESM loans following a European financial assistance programme existing at the time of the signature of this Treaty, the ESM will enjoy the same seniority as all other loans and obligations of the beneficiary ESM Member, with the exception of the IMF loans.

During the transitional phase spanning the period from the entry into force of this Treaty until the complete run‑down of the EFSF, the consolidated ESM and EFSF lending shall not exceed EUR 500 000 million, without prejudice to the regular review of the adequacy of the maximum lending volume in accordance with Article 10.

Must Article 10 EC, read in conjunction with Article 49 EC, be understood as prohibiting an interpretation of a provision such as Article 29(2)(d) of the Law of 11 April 1983, which makes the grant of a tax credit, the notional withholding tax, to the recipients of income from debt-claims or loans granted to a coordination centre, within the meaning of Royal Decree No 187 of 30 December 1982 on the creation of coordination centres, subject to the condition that no right to use the tangible asset financed by means of those debt-claims or loans is conferred on a member of the group established in another Member State, by any company in the group, and not only by the company which acquires the tangible asset through that financing, and which uses it in Belgium in the exercise of its business activity?

Cependant, en raison du moratoire sur la construction des centrales nucléaires au sein de l'UE, de l'épuisement des crédits alloués par le Conseil au profit du Nouvel Instrument Communautaire (NIC) et de l'arrêt des prêts CECA à l'approche du terme du traité en 2002, la Commission est d'avis qu'il n'y a plus matière à informer le Conseil et le Parlement sur l'activité communautaire de prêt en ce qui concerne les instruments opérant à l'intérieur du territoire communautaire.
However, in view of the moratorium on the construction of nuclear power stations within the EU, the fact that the appropriations allocated by the Council to the New Community Instrument (NCI) have been used up and the cessation of ECSC loans as the expiry of the ECSC Treaty in 2002 approaches, the Commission considers that there is no longer any need to inform the Council and Parliament of Community lending activities under the instruments applicable within the Community.
