Insofar as its provisions relate to SIS II as governed by Regulation (EC) No 1987/2006 and to VIS, which constitute developments of provisions of the Schengen acquis in which the United Kingdom does not take part in accordance with Decision 2000/365/EC , the United Kingdom requested, by letter of 5 October 2010 to the President of the Council, to be authorised to take part in the adoption of this Regulation, in accordance with Article 4 of the Protocol on the Schengen acquis integrated into the framework of the European Union, annexed to the TEU and to the TFEU.

(24) Le Royaume-Uni participe au présent règlement, dans la mesure où les dispositions du présent règlement portent sur le SIS II tel qu'il est régi par la décision 2007/533/JAI, conformément à l'article 5, paragraphe 1, du protocole n° 19 sur l'acquis de Schengen intégré dans le cadre de l'Union européenne, annexé au traité UE et au traité FUE, et conformément à l'article 8, paragraphe 2, de la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord de participer à certaines dispositions de l'acquis de Schengen.
(24) Insofar as its provisions relate to SIS II as governed by Decision 2007/533/JHA, the United Kingdom is taking part in this Regulation, in accordance with Article 5(1) of the Protocol No 19 on the Schengen acquis integrated into the framework of the European Union, annexed to the TEU and to the TFEU, and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis.

U. considérant en particulier que la coopération renforcée dans ce domaine est conforme aux traités et au droit de l'Union puisqu'elle ne porte pas atteinte à l'acquis, dès lors qu'à ce jour, seul un nombre restreint d'actes juridiques de l'Union au sens de l'article 288 du traité FUE a été adopté, dont aucun ne concerne la création d'un titre européen de propriété intellectuelle assurant une protection uniforme dans toute l'Union; considérant que, hormis la directive 98/44/CE du Parlement européen et du Conseil du 6 juillet 1998 relative à la protection juridique des inventions biotechnologiques, il n'y a pas eu de rapprochement du droit matériel des brevets au niveau de l'Union, et que le règlement (CE) n° 1610/96 du Parlement européen et du Conseil du 23 juillet 1996 concernant la création d'un certificat complémentaire de protection pour les produits phytopharmaceutiques et le règlement (CE) n°469/2009 du Parlement européen et du Conseil du 6 mai 2009 concernant le certificat complémentaire de protection pour les médicaments portent sur la prolongation de la durée des brevets de certaines catégories particulières; considérant que la coopération renforcée dans le domaine des brevets n'entraînerait pas de discrimination, l'accès au brevet unitaire étant ouvert à tous les usagers du système de brevet de l'ensemble de l'Union,
U. whereas, in particular, enhanced cooperation in this area complies with the Treaties and Union law since it will not affect the acquis, given that, to date, only a limited number of legal acts of the Union within the meaning of Article 288 TFEU have been adopted, none of them covering the creation of a European intellectual property right providing for uniform protection throughout the Union; whereas, with the exception of Directive 98/44/EC of the European Parliament and of the Council of 6 July 1998 on the legal protection of biotechnological inventions, no approximation of substantive patent law exists at Union level, and whereas Regulation (EC) No 1610/96 of the European Parliament and of the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products and Regulation (EC) No 469/2009 of the European Parliament and of the Council of 6 May 2009 concerning the supplementary protection certificate for medicinal products concern patent term extensions for specific types of patented subject matter; whereas enhanced cooperation in the area of patents would not cause discrimination since access to the unitary patent will be open to users of the patent system from all over the Union,
