Le groupe d'experts désigné par le comité scientifique et technique a émis l'avis que les normes de base établies conformément aux articles 30 et 31 du traité Euratom devraient tenir compte des nouvelles recommandations de la Commission internationale de protection radiologique (CIPR), notamment celles de la publication 103 (7) de la CIPR, et devraient être révisées à la lumière des connaissances scientifiques et de l'expérience opérationnelle récentes.
The Group of Experts appointed by the Scientific and Technical Committee has advised that the basic safety standards, established according to Articles 30 and 31 of the Euratom Treaty, should take into account the new recommendations of the International Commission on Radiological Protection (ICRP), in particular those in ICRP Publication 103 (7), and should be revised in the light of new scientific evidence and operational experience.

Pursuant to Article 106a(3) of the Euratom Treaty, the legislation adopted on the basis of the provisions of the Treaty on European Union and of the Treaty on the Functioning of the European Union should not derogate from the provisions of this Directive, and consequently the justification and optimisation principles should apply notably for medical devices and construction products covered by CE marking.

Les compétences d'exécution relatives à la programmation et au financement des actions soutenues en vertu du présent règlement devraient être exercées conformément au règlement (UE) no 182/2011 du Parlement européen et du Conseil (7), qui doit s'appliquer aux fins du présent règlement, nonobstant el fait qu'il n'y soit pas fait mention de l'article 106 bis du traité Euratom.
The implementing powers relating to the programming and financing of the actions supported under this Regulation, should be exercised in accordance with Regulation (EU) No 182/2011 (7), which is to apply for the purpose of this Regulation, notwithstanding the fact that it does not refer to Article 106a of the Euratom Treaty.

Investigations should be conducted in accordance with the Treaties and in particular with Protocol No 7 on the privileges and immunities of the European Union, while respecting the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Union laid down in Council Regulation (EEC, Euratom, ECSC) No 259/68 (‘the Staff Regulations’) and the Statute for Members of the European Parliament, and with full respect for human rights and fundamental freedoms, in particular the principle of fairness, for the right of persons involved to express their views on the facts concerning them and for the principle that the conclusions of an investigation may be based solely on elements which have evidential value.
