par un arrêt avant-dire droit, condamner l’Union européenne, par application de l’article 340, deuxième alinéa, du traité sur le fonctionnement de l’Union européenne, à indemniser l’intégralité du préjudice patrimonial subi par tous les requérants pendant la période comprise entre le 1er janvier 2012 et le début de leur activité d’agents publics d’exécution croates conformément aux dispositions de l’article 36, paragraphe 1, et de l’annexe VII, point 1, de l’acte d’adhésion, qui sont juridiquement contraignants pour tous les 28 pays signataires du traité d’adhésion de la République de Croatie à l’Union européenne, du 9 décembre 2011, ainsi que pour la Commission européenne, ce préjudice résultant du fait que la Commission européenne n’a pas exercé les pouvoirs de contrôle (monitoring) qui lui ont été conférés par l’article 36, paragraphes 1 et 2, de l’acte d’adhésion en vue de veiller à ce que la République de Croatie s’acquitte de son engagement d’assurer que les agents publics d’exécution croates puissent commencer à exercer le 1er janvier 2012, engagement qui a été pris lors des négociations relatives à l’adhésion de la République de Croatie à l’Union européenne dans le cadre du chapitre 23 — Pouvoir judiciaire et droits fondamentaux et qui a été énoncé à l’annexe VII, point 1, de l’acte d’adhésion, «Engagements spécifiques pris par la République de Croatie au cours des négociations d'adhésion», lequel prévoit: «1.
By means of an interim measure, order the European Union to compensate, on the basis of Article 340(2) of the Treaty on the Functioning of the European Union, all of the material damage suffered by all the applicants during the period from 1 January 2012 to the time at which the applicants began to exercise the functions of Croatian bailiffs in accordance with Article 36(1) and Annex VII(1) of the Act of Accession, legally binding on all 28 signatory States of the Treaty of Accession of the Republic of Croatia to the European Union, including the Commission since 9 December 2011, as a result of the European Commission’s failure to fulfil its monitoring obligation under Article 36(1) and (2) of the Act of Accession, intended to ensure that the Republic of Croatia would establish the profession of bailiff from 1 January 2012, a commitment undertaken during the negotiations on the accession of the Republic of Croatia to the European Union in the context of Chapter 23, ‘Justice and Fundamental Rights’, referred to in section 1 of Annex VII of the Act of Accession, ‘Specific commitments undertaken by the Republic of Croatia in the accession negotiations’, which states: ‘1. To continue to ensure effective implementation of its Judicial Reform Strategy and Action Plan’.

2. souligne la nature purement technique de cette révision, qui n'est que la conséquence de l'accord unanime sur le traité concernant l'adhésion de la République de Croatie à l'Union européenne (le traité d'adhésion) en tant que vingt-huitième État membre de l'Union; souligne que, pour ce motif, la révision de l'accord interinstitutionnel du 17 mai 2006 accompagnant le budget rectificatif n° 1/2013 a été exclue du débat politique interinstitutionnel en cours relatif aux modalités de règlement des paiements de 2012 restant à liquider et des négociations du budget rectificatif n° 2/2013;
2. Emphasises the purely technical nature of this revision, which is simply the consequence of the unanimous agreement on the Treaty concerning the Accession of the Republic of Croatia to the European Union (the Accession Treaty) as the 28th Member State of the Union; stresses that for that reason the revision of the IIA of 17 May 2006 accompanying Amending budget No 1/2013 has been kept separate from the ongoing political inter-institutional debate on how to settle the issue of outstanding payments from 2012 and from the negotiations on Amending budget No 2/2013;

3. souligne que, en ratifiant le traité d'adhésion, la République de Croatie est réputée avoir également ratifié toute modification des traités ouverte à la ratification ou à l'approbation par les États membres en vertu de l'article 48 du traité UE au moment de la ratification du traité d'adhésion par la Croatie, à savoir la modification de l'article 136 du traité FUE et éventuellement aussi des protocoles envisagés pour les garanties demandées par l'Irlande et la dérogation en faveur de la République tchèque;
3. Points out that by ratifying the Accession Treaty the Republic of Croatia is also deemed to have ratified any amendments to the Treaties open for ratification or approval by the Member States, pursuant to Article 48 TEU, at the time of its ratification of the Accession Treaty, namely the amendment to Article 136 TFEU and possibly also protocols that are envisaged concerning guaranties requested by Ireland and a derogation for the Czech Republic;

À cet égard, il se distingue clairement d’autres dispositions du traité d’adhésion de 2003, comme par exemple le mécanisme transitoire prévu à l’annexe IV («aide existante») qui a trait uniquement aux aides d’État accordées avant l’adhésion et «toujours applicables après» la date de l’adhésion.
In this respect, it clearly differs from other provisions of the 2003 Accession Treaty, such as the interim mechanism set out in Annex IV (the ‘existing aid procedure’), which only concerns State aid granted before accession in so far as it is ‘still applicable after’ the date of accession.

Les mesures qui ont été mises à exécution avant l'adhésion et ne sont plus applicables après l'adhésion ne peuvent être examinées par la Commission ni sur la base des «dispositions temporaires» prévues à l'annexe IV, point 3, du traité d'adhésion, ni au titre des procédures définies à l'article 88 du traité CE.
Measures that were put into effect before accession and are no longer applicable after accession cannot be examined by the Commission either under the so-called interim mechanism procedure, governed by Annex IV, point 3 of the Accession Treaty, or under the procedures laid down in Article 88 of the EC Treaty.

1. souligne à nouveau qu'il va continuer à suivre étroitement le processus qui conduira à l'adhésion de la Bulgarie et de la Roumanie et demande que la Commission le tienne régulièrement informé du respect par les autorités bulgares et roumaines des engagements pris dans le cadre du traité d'adhésion; souligne qu'il a approuvé les traités d'adhésion à condition que le Conseil et la Commission l'associent pleinement à la prise de décision pour le cas où les clauses de sauvegarde contenues dans le traité d'adhésion devraient être utilisées dans le cadre de l'adhésion de la Bulgarie et de la Roumanie;

Stresses once again that it will continue to follow closely the process which will lead to Bulgaria's and Romania's accession, and calls on the Commission to keep it regularly informed of the extent to which the Bulgarian and Romanian authorities honour the commitments made in the accession treaty; stresses that its approval of the accession treaties was given on condition that the Council and Commission fully involve Parliament in decision-making in the event of the safeguard clauses in the accession treaty being used in the context of Bulgaria's and Romania's accession;

3. souligne à nouveau qu'il va continuer à suivre étroitement le processus qui conduira à l'adhésion de la Bulgarie et de la Roumanie et demande que la Commission le tienne régulièrement informé du respect par les autorités bulgares et roumaines des engagements pris dans le cadre du traité d'adhésion; souligne qu'il a approuvé les traités d'adhésion à condition que le Conseil et la Commission l'associent pleinement à la prise de décision pour le cas où les clauses de sauvegarde contenues dans le traité d'adhésion devraient être utilisées dans le cadre de l'adhésion de la Bulgarie et de la Roumanie;

Stresses once again that Parliament will continue to follow closely the process which will lead to Bulgaria's and Romania's accession, and calls on the Commission to keep Parliament regularly informed of the extent to which the Bulgarian and Romanian authorities honour the commitments made in the accession treaty; stresses that the approval of the accession treaties was given on condition that the Council and Commission will fully involve Parliament in any decision-making should the safeguard clauses contained in the accession treaty be invoked in the context of Bulgaria's and Romania's accession;

21. va continuer à suivre étroitement le processus qui conduira à l'adhésion de la Roumanie en janvier 2007 et demande que la Commission le tienne régulièrement informé du respect par les autorités roumaines des engagements pris dans le cadre du traité d'adhésion, notamment en ce qui concerne la lutte contre la corruption, l'environnement, le domaine de la justice et des affaires intérieures et la concurrence; tient à souligner qu'il approuve le traité d'adhésion à condition que le Conseil et la Commission l'associent pleinement à la prise de décision pour le cas où les clauses de sauvegarde contenues dans le traité d'adhésion devraient être utilisées dans le cadre de l'adhésion de la Roumanie;
21. Will continue to follow closely the process which will lead to Romania's accession in January 2007 and calls on the Commission to keep it regularly informed of the extent to which the Romanian authorities honour the commitments given in the accession treaty, particularly as regards the fight against corruption, the environment, the field of justice and home affairs and competition; stresses that it approves the accession treaty on condition that the Council and the Commission fully involve it in the decision-making in the event that the safeguard clauses contained in the accession treaty were to be used in the context of Romania's accession;

En vertu du traité d'adhésion de 2003, l'adhésion des nouveaux États membres aura lieu le 1er mai 2004; il convient dès lors d'adapter le présent règlement, à la date d'adhésion, conformément aux procédures prévues par le traité d'adhésion afin de le rendre applicable aux nouveaux États membres.
Taking into account the fact that, according to the Treaty of Accession of 2003, the accession of the new Member States is to take place on 1 May 2004, this Regulation should be adapted, by the date of accession, according to the procedures provided for by that Treaty, in order to make it applicable to the new Member States.

The Seville European Council stated that "drafting of the Treaty of Accession should continue so that it can be completed as soon as possible after the conclusion of the accession negotiations. It would seem reasonable to expect that the Treaty of Accessioncould be signed in spring 2003".
