Le présent règlement constitue un accord particulier au sens de l'article 142 de la CBE, un traité de brevet régional au sens de l'article 45, paragraphe 1, du traité de coopération en matière de brevets du 19 juin 1970 et un arrangement particulier au sens de l'article 19 de la Convention pour la protection de la propriété industrielle, signée à Paris le 20 mars 1883 et révisée en dernier lieu le 14 juillet 1967.
This Regulation constitutes a special agreement within the meaning of Article 142 of the EPC, a regional patent treaty within the meaning of Article 45(1) of the Patent Cooperation Treaty of 19 June 1970 and a special agreement within the meaning of Article 19 of the Convention for the Protection of Industrial Property, signed in Paris on 20 March 1883 and last revised on 14 July 1967.

This Regulation constitutes a special agreement within the meaning of Article 142 of the EPC, a regional patent treaty within the meaning of Article 45(1) of the Patent Cooperation Treaty of 19 June 1970 as last modified on 3 February 2001 and a special agreement within the meaning of Article 19 of the Convention for the Protection of Industrial Property, signed in Paris on 20 March 1883 and last amended on 28 September 1979.

Les litiges ayant trait aux brevets communautaires seront traités par une chambre d'appel spécialisée, qui sera créée au sein du Tribunal de première instance en application de l'article 61 bis du statut, tel que modifié par l'article 9 de la présente décision.
Community patent cases would be heard by a specialised appeal chamber which should be set up within the Court of First Instance in accordance with Article 61a of the Statute as amended by Article 6 of this Decision.

whereas, in particular, enhanced cooperation in this area complies with the Treaties and Union law since it will not affect the acquis, given that, to date, only a limited number of legal acts of the Union within the meaning of Article 288 TFEU have been adopted, none of them covering the creation of a European intellectual property right providing for uniform protection throughout the Union; whereas, with the exception of Directive 98/44/EC of the European Parliament and of the Council of 6 July 1998 on the legal protection of biotechnological inventions (5), no approximation of substantive patent law exists at Union level, and whereas Regulation (EC) No 1610/96 of the European Parliament and of the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products (6) and Regulation (EC) No 469/2009 of the European Parliament and of the Council of 6 May 2009 concerning the supplementary protection certificate for medicinal products (7) concern patent term extensions for specific types of patented subject matter; whereas enhanced cooperation in the area of patents would not cause discrimination since access to the unitary patent will be open to users of the patent system from all over the Union,

La principale raison de ce phénomène est l'importance de la quantité de contrôles à réaliser par l'OEB dans le cadre des demandes au titre du Traité de coopération en matière de brevets (PCT). Aux termes de ce traité, les pays qui ont adhéré à ce traité (plus de 100) peuvent choisir l'un des neuf offices internationaux de brevets pour procéder au contrôle et/ou à l'examen préliminaire.
The major reason for this is the large amount of searches that has to be handled by the EPO in the framework of PCT applications.
