1. Lorsqu'une translittération ou une traduction est exigée en vertu du présent règlement, ladite translittération ou traduction est effectuée dans la langue officielle de l'État membre concerné ou, lorsque ledit État membre compte plusieurs langues officielles, dans la langue officielle ou l'une des langues officielles des procédures judiciaires du lieu d'exécution, conformément à la législation de cet État membre.
1. When a transliteration or translation is required under this Regulation, such transliteration or translation shall be into the official language of the Member State concerned or, where there are several official languages in that Member State, into the official language or one of the official languages of court proceedings of the place of enforcement, in accordance with the law of that Member State.

Si la traduction originale et la traduction officielle ou certifiée commandée par les autorités diffèrent fortement (si la traduction s'avère, par exemple, incomplète, incompréhensible ou erronée), les autorités peuvent exiger que la personne ayant remis le document rembourse le coût de la traduction .
If there are substantial differences between the translation and the certified or official translation commissioned by the authority, i.e. if the translation is incomplete, incomprehensible or misleading, the authority may require the person submitting the document to reimburse the costs of the translation.

(11) During a transitional period, before a system of high quality machine translations into all official languages of the Union becomes available, a request for unitary effect as referred to in Article 12 of Regulation xx/xx [substantive provisions] shall be accompanied by a full translation of the specification of the patent into English where the language of the proceedings before the European Patent Office is French or German, or into any official language of the participating Member States that is an official language of the Union where the language of the proceedings before the European Patent Office is English.

Durant une période de transition, toute demande d’effet unitaire visée par l’article 12 du règlement xx/xx mettant en œuvre la coopération renforcée dans le domaine de la création d’une protection par brevet unitaire devra donc être accompagnée: i) d’une traduction en anglais de l’intégralité du fascicule du brevet, si la langue de la procédure engagée devant l’OEB conformément à l’article 14, paragraphe 3, de la CBE est le français ou l’allemand; ou ii) d’une traduction de l’intégralité du fascicule du brevet dans une langue officielle des États membres participants qui soit une langue officielle de l'Union, si la langue de la procédure engagée devant l’OEB est l’anglais.
Therefore, during a transitional period, a request for unitary effect as referred to in Article 12 of Regulation xx/xx implementing enhanced cooperation in the area of the creation of unitary patent protection shall be accompanied by the following: (i) a full translation of the specification of such patent into English where the language of the proceedings before the EPO in accordance with Article 14(3) of the EPC is French or German; or (ii) a full translation of the specification of such patent into any official language of the participating Member States that is an official language of the Union where the language of the proceedings before the EPO is English.

D'autre part, nous pensons également que les citoyens devraient pouvoir avancer une revendication de brevet dans leur propre langue, et que celle-ci soit ensuite traduite dans toutes les autres langues - non pas le processus complet, mais juste, comme le dit l'amendement 20, paragraphe c : "le brevet communautaire est consigné dans la langue de soumission et dans la langue officielle dans laquelle la procédure de demande s'est déroulée ; il doit être accompagné des traductions des revendications et d'un résumé dans les autres langues officielles de la Communauté européenne", et ensuite, comme il est stipulé dans le paragraphe d, "les traductions sont effectuées par le Centre de traduction des organes de l'Union européenne, qui en supporte les frais".
On the other hand, we also believe that people should be able to put forward a patent claim in their own language. We then believe that it should be translated into all the other languages – not the whole process but just, as it says in Amendment No 20(c), "issued in the language of submission and in the official language in which the procedure has been carried out, accompanied by translation of the patent claims and of a short abstract in the other official languages of the Community", and then paragraph (d), "translations shall be performed by the Translation Centre for the bodies of the European Union and costs borne by the European Union".

In fact, article 10, paragraph 6 states: "Lack of scientific certainty due to insufficient relevant scientific information and knowledge regarding the extent of the potential adverse effects of a living modified organism on the conservation and sustainable use of biological diversity in the Party of import, taking also into account risks to human health, shall not prevent that Party from taking a decision, as appropriate, with regard to the import of living modified organism in question as referred to in paragraph 3 above, in order to avoid or minimize such potential adverse effects".
