TRADUCTIONS EN CONTEXTE

Toute transition devra respecter le cadre juridique et financier applicable au marché intérieur, pour citer le Conseil européen : "S'il devait être envisagé de proroger l'acquis de l'Union pour une durée limitée, il faudrait appliquer les instruments et structures de l'Union qui existent en matière de réglementation, de budget, de surveillance, d'exercice du pouvoir judiciaire et de contrôle du respect des règles".
Any transition must respect the legal and financial framework of the Single Market. To quote the European Council: "Should a time-limited prolongation of Union acquis be considered, this would require existing Union regulatory, budgetary, supervisory, judiciary and enforcement instruments and structures to apply".

(11) During a transitional period, before a system of high quality machine translations into all official languages of the Union becomes available, a request for unitary effect as referred to in Article 12 of Regulation xx/xx [substantive provisions] shall be accompanied by a full translation of the specification of the patent into English where the language of the proceedings before the European Patent Office is French or German, or into any official language of the participating Member States that is an official language of the Union where the language of the proceedings before the European Patent Office is English.

Durant une période de transition, toute demande d’effet unitaire visée par l’article 12 du règlement xx/xx mettant en œuvre la coopération renforcée dans le domaine de la création d’une protection par brevet unitaire devra donc être accompagnée: i) d’une traduction en anglais de l’intégralité du fascicule du brevet, si la langue de la procédure engagée devant l’OEB conformément à l’article 14, paragraphe 3, de la CBE est le français ou l’allemand; ou ii) d’une traduction de l’intégralité du fascicule du brevet dans une langue officielle des États membres participants qui soit une langue officielle de l'Union, si la langue de la procédure engagée devant l’OEB est l’anglais.
Therefore, during a transitional period, a request for unitary effect as referred to in Article 12 of Regulation xx/xx implementing enhanced cooperation in the area of the creation of unitary patent protection shall be accompanied by the following: (i) a full translation of the specification of such patent into English where the language of the proceedings before the EPO in accordance with Article 14(3) of the EPC is French or German; or (ii) a full translation of the specification of such patent into any official language of the participating Member States that is an official language of the Union where the language of the proceedings before the EPO is English.

Conformément à ces dispositions, l’Union européenne rappelle à toutes les parties que la date du 30 juin 2006 est la date ultime à laquelle la Transition devra prendre fin.
In accordance with these arrangements, the European Union would remind all parties that 30 June 2006 is the final deadline for the end of the transition.

Dans le cadre de la coopération avec les pays et régions d'origine et de transit en général, une attention toute particulière devra être accordée tant à la lutte contre la pauvreté qu'au respect des droits de l'homme.

Pour le reste, s'il faut une période de transition et d'adaptation, je n'y serais pas opposée pour autant que les conditions suivantes soient remplies : - il devra s'agir d'une période brève, quelques années tout au plus; - la suppression définitive des duty free pour les voyages intra- communautaires à l'issue de cette période devra être automatique, sans remise en cause possible de ce "délai de grâce"; - enfin, pendant cette période, le système des duty free devra fonctionner sans contrôles aux frontières intérieures puisque ceux-ci seront supprimés dès le 1er janvier 1993.
For the rest, if a period of transition and adjustment is required, I could agree to it on the following conditions: it should be short: a few years at most; duty-free sales to travellers within the Community should be automatically discontinued at the end of this grace period, with no possibility of backpedaling; during the period, the duty-free sales system would have to operate without customs checks at internal borders, since such checks will be discontinued on 1 January 1993.
