En second lieu, le fait que M. Tomczak puisse perdre son siège au sein de ce Parlement ne peut pas être considéré comme un motif de poursuite puisqu’à l’époque de l’incident, le 19 juin 2004, M. Tomczak n’était pas député européen et que la loi applicable aux parlementaires nationaux ne contient aucune disposition prévoyant de telles conséquences.
Secondly, the possibility of Mr Tomczak’s losing his seat in this Parliament cannot be considered as a motive for the prosecution, as, at the time of the incident of 19 June 2004, Mr Tomczak was not a Member of the European Parliament, and the law applicable to national parliamentarians does not contain provisions for such consequences.
