2. Dans le programme de La Haye des 4 et 5 novembre 2004, le Conseil européen a reconnu que l'UE devait contribuer, dans un esprit de responsabilité partagée, à la mise en place d'un régime de protection internationale plus accessible, équitable et efficace, en partenariat avec les pays tiers, et permettre l'accès à la protection et à des solutions durables au stade le plus précoce. Une distinction est établie entre les besoins différents des pays dans des régions de transit et les pays dans des régions d’origine. Les efforts déployés par les pays situés dans les régions d'origine et de transit pour renforcer leurs capacités en matière de protection des réfugiés seront encouragés. En ce qui concerne les pays et régions d'origine, le Conseil européen a invité en outre la Commission à élaborer des programmes de protection régionaux de l'UE en partenariat avec les pays tiers concernés et en étroite consultation et coopération avec le Haut Commissariat des Nations unies pour les réfugiés. 2. In the Hague Programme of 4-5 November 2004, the European Council acknowledged the need for the EU to contribute, in a spirit of shared responsibility to a more accessible, equitable and effective international protection system in partnership with third countries and to provide access to protection and durable solutions at the earliest possible stage. A distinction was drawn between the differing needs of countries in regions of transit and countries in regions of origin. Countries in regions of origin and transit will be encouraged in their efforts to strengthen their capacity for the protection of refugees. On countries and regions of origin, the European Council further invited the Commission to develop EU Regional Protection Programmes in partnership with the third countries concerned and in close consultation and cooperation with UNHCR. These programmes should build on experience gained in pilot protection programmes to be launched before the end of 2005. These programmes will incorporate a variety of relevant instruments, primarily focused on capacity building, and include a joint resettlement programme for those Member States which may be ready to participate in such a programme on a voluntary basis. With regard to countries of transit, the European Council emphasised the need for intensified cooperation and capacity building, both on the southern and eastern borders of the EU to enable those countries better to manage migration and to provide adequate protection for refugees.

3. S'il s'avère soit après une procédure d'examen, soit avant son terme, pendant ou après une procédure de règlement d'un différend international, que le meilleur moyen de régler un différend suscité par un obstacle aux échanges est de conclure, avec le ou les pays tiers concernés, un accord susceptible de modifier les droits substantiels de la Communauté ou du ou des pays tiers concernés, la procédure sera suspendue conformément à l'article 14 et des négociations seront entamées conformément à l'article 113 du traité.
3. Where, either after an examination procedure, or at any time before, during and after an international dispute settlement procedure, it appears that the most appropriate means to resolve a dispute arising from an obstacle to trade is the conclusion of an agreement with the third country or countries concerned, which may change the substantive rights of the Community and of the third country or countries concerned, the procedure shall be suspended according to the provisions of Article 14, and negotiations shall be carried out according to the provisions of Article 113 of the Treaty.
