12. déplore que les marchés publics de nos principaux partenaires ne soient pas aussi ouverts que ceux de l'Union européenne; soutient vivement les travaux de la Commission visant à réviser la législation européenne en matière de marchés publics, et notamment l'application des mesures nécessaires pour assurer un accès équitable des entreprises de l'Union aux marchés publics des États tiers, d'une part, et des entreprises des États tiers aux marchés publics de l'Union européenne, d'autre part, sur la base du principe de réciprocité, et à renforcer la position de l'Union lorsqu'elle négocie l'accès des entreprises européennes aux marchés publics des pays tiers; estime que la réciprocité est nécessaire dans ce domaine entre l'Union européenne, les pays industrialisés et leurs principaux partenaires émergents; fait toutefois observer que ces mesures doivent être conçues de manière à ne pas engendrer de nouveaux cloisonnements indésirables du marché, qui pourraient à leur tour avoir des conséquences négatives pour l'industrie européenne et ses relations commerciales mondiales; souligne, par conséquent, la nécessité de politiques fondées sur des données factuelles et d'une analyse d'impact approfondie, ainsi que d'une évaluation des risques et des avantages pour les entreprises de l'Union et les parties prenantes du secteur public, en vue de la présentation de propositions législatives; invite la Commission à lui soumettre une proposition législative avant la fin de 2011, comme le précise la communication relative à l'acte sur le marché unique;
12. Regrets the fact that the public procurement procedures of our principal partners are not as open as those of the European Union; strongly supports the Commission’s work to revise EU legislation on public procurement, in particular the introduction of the measures needed to ensure fair access both for EU businesses to procurement procedures in third countries and for third-country businesses to European procedures, on the basis of the principle of reciprocity, and to strengthen the EU’s position when negotiating access for European businesses to third-country public procurement procedures; considers that reciprocity is needed in this field between the EU, industrialised countries and major emerging partners; stresses, however, that these measures must take such a form that they do not lead to inappropriate new partitioning of the market, which in turn might have negative repercussions for European industry and its global trade relations; stresses, therefore, the need for evidence-based policy making and a thorough impact assessment as well as an assessment of the relative risks and benefits for EU business and public sector stakeholders, with a view to proposing legislation; calls on the Commission to submit a legislative proposal by the end of 2011 at the latest, as specified in the Communication on the Single Market Act;

28. Stresses that a smoothly functioning internal market and a well-balanced social market economy are the strongest competitive advantage for Europe; points out that for third‑country investors the internal market offers advantages such as a level playing field and free movement, but that access to the internal market should be accompanied by a similar openness to EU investors on the part of third countries with developed and emerging economies, which is the key factor in attracting foreign investment and increasing trade with third countries; notes that, in addition, we need to create the best framework conditions for European enterprises, including better regulation, good governance, sound and fair competition, efficiently functioning venture-capital markets and commercialisation of the results of research and innovation;
