K. considérant que l'état de droit – l'un des principes fondamentaux de l'Union – implique non seulement le respect de la démocratie et des droits de l'homme, mais aussi du droit international, la garantie d'une justice équitable, ainsi que l'indépendance et l'impartialité du pouvoir judiciaire; que ces conditions ne sont pas remplies en Russie, où les autorités ne garantissent pas l'état de droit et ne respectent pas les droits fondamentaux et où les droits politiques, les libertés civiles et la liberté des médias se sont détériorées ces dernières années; que des textes législatifs comportant des dispositions ambiguës utilisées pour imposer davantage de restrictions aux opposants et aux acteurs de la société civile ont été adoptés récemment; que l'adoption récente de la loi criminalisant la prétendue "propagande homosexuelle" a débouché sur une recrudescence des violences homophobes et anti LGBTI et des discours haineux, dont les autorités ne se sont pas préoccupées; qu'à la suite de l'annexion illégale de la Crimée, le respect des droits de l'homme, y compris de la liberté d'expression, de réunion et d'association, s'est gravement détérioré dans la péninsule, la communauté tatare de Crimée étant particulièrement touchée;
K. whereas the rule of law, as one of the fundamental principles of the EU, implies not only respect for democracy and human rights, but also compliance with international law, the assurance that the law is fairly enforced and applied, as well as the independence and impartiality of the judiciary; whereas these conditions are not met in Russia, where the authorities fail to uphold the rule of law and to respect fundamental rights, and where political rights, civil liberties and media freedom have deteriorated in recent years; whereas legislation has recently been passed with ambiguous provisions that are used to place further restrictions on opposition and civil-society actors; whereas the recent adoption of the law criminalising so-called ‘homosexual propaganda’ has led to an increase in homophobic and anti-LGBTI violence and hate speech, which the authorities have failed to address; whereas, following the illegal annexation of Crimea, respect for human rights, including freedom of expression, assembly and association, has suffered a serious deterioration in the peninsula, the Crimean Tartar community being particularly affected;

(11 ) In order to achieve those objectives, a transparent and coherent legislative framework is required, which includes a definition of good environmental status and is linked to the principles of the Common Fisheries Policy, to provide an overall framework for action and to enable the action taken to be coordinated, and consistent, and properly integrated with action under other Community legislation as well as international agreements.
