Bien souvent, les retards dans la transposition des directives ne résultent pas d'une abstention volontaire de l'Etat membre, mais de problèmes administratifs internes, voire d'une difficulté de compréhension de textes législatifs communautaires souvent complexes.
Delays in transposing directives are all too often not the result of a deliberate refusal to act on the part of the Member State but of domestic administrative problems and in particular problems of understanding often complex Community legislative texts.
