The draft Report has not changed the definitions of "terrorist offence" and "serious crime" However, it limits the text to "serious transnational crime" only with a list of specific offences taken from the FD 2002/584/JHA list.

Under the text, "terrorist offences" refer to those in Articles 1 to 4 of Council Framework Decision 2002/475/JHA; and "serious crimes" are also defined with reference to "Article 2(2) of Council Framework Decision 2002/584/JHA, but only those punishable by a custodial sentence or a detention order for a maximum period of at least three years under the national law of a Member State", although some flexibility is allowed here.

2. 2. When sending the information letter to the owner, the holder of the vehicle or to the otherwise identified person suspected of committing the road-safety-related traffic offence, the Member State of the offence shall, in accordance with its law, include any relevant information, notably the nature of this road-safety-related traffic offence, the place, date and time of the offence, the title of the texts of the national law infringed and the sanction and, where appropriate, data concerning the device used for detecting the offence.

A criminal organisation is defined as "a structured association, established over a period of time, of more than two persons, acting in concert with a view to committing offences which are punishable by deprivation of liberty or a detention order of a maximum of at least four years or a more serious penalty, whether such offences are an end in themselves or a means of obtaining material benefits and, where appropriate, of improperly influencing the operation of public authorities".

2.2.7 La disposition de la directive EIE le plus fréquemment en cause dans les procédures d'infraction est son article 4, paragraphe 2, notamment en ce qui concerne la « vérification préliminaire » en elle-même, l'application des seuils et l'énumération des projets relevant de l'annexe 2. Tant à la lumière de l'ancien texte de la directive qu'à la lumière du nouveau texte, l'appréciation des caractéristiques des projets relevant de l'annexe II (afin de déterminer si tel ou tel projet doit ou non faire l'objet d'une EIE) est souvent incorrectement menée (ce qui constitue un cas de mauvaise application).
2.2.7 The provision which is more frequently concerned in infringement procedures on EIA Directive is Article 4(2) in particular as regards 1) the "screening" in itself, 2) the application of the thresholds, and 3) the listing of the projects of Annex II. Both under the old and the new version of the Directive, the assessment of the characteristics of Annex II projects (in order to determine, in individual cases, whether the project is to be made the subject of an EIA) is often not correctly carried out (this is a case of wrong application).

The Commission has subscribed to this interpretation from the outset and considers that the solution we are working towards respects the basic structure of the Commission’s initial proposal, which is to, “define a terrorist offence on the basis of the identification of an objective factor: the terrorist act, accompanied by the identification of a subjective element: a terrorist motivation under the terms of the proposal”. This is the text currently under consideration by the Council. At the same time, the solution also provides more detail on allowing the requirements that must be met for the offence included in the positive list to be considered a terrorist offence, to be identified in legislation itself. We are, therefore, in favour of improving the definition contained in the text currently being studied by the Council.

Article 5(2) could be completed as follows: ‘The offence notification shall contain the name of the authority responsible for the enforcement of sanctions and the purpose of the notification, a description of the offence concerned (.), the possibilities for the holder to contest the grounds of the offence notification and to appeal (.), and the procedure to be followed (.).
