Il discrimine à tort certains groupes en les obligeant notamment à se soumettre à des tests involontaires, en faisant fi de la réciprocité, en ne traitant pas des citoyens égaux de la même façon et en limitant les tests involontaires au VIH, à l'hépatite B et à l'hépatite C. En somme, la BC Civil Liberties Association ne voit aucun besoin démontré de changer la tradition du consentement éclairé. Elle croit que les tests involontaires ne procurent que des avantages minimes et incertains et que le projet de loi ne permet explicitement que l'atteinte à la vie privée et à l'intégrité physique de certains groupes à risque, comme les prostituées et les consommateurs de drogues.
In sum, the B.C. Civil Liberties Association believes there is no proven need to depart from the tradition of informed consent; that benefits of involuntary testing are marginal and speculative; and that the bill explicitly targets certain risk groups, such as prostitutes and drug users, for violations of their bodily integrity and privacy.
