Cette dernière initiative – au sujet de laquelle le Conseil a convenu d’une approche commune – a pour objectif d’harmoniser les dispositions nationales relatives aux provocations publiques à commettre une infraction terroriste ainsi qu’au recrutement et à l’entraînement de terroristes, de sorte que ces agissements soient passibles de poursuites dans toute l’UE, y compris lorsqu’ils sont commis au moyen d’Internet, et de garantir que les dispositions existantes relatives aux peines, à la responsabilité des personnes morales ainsi qu’à la compétence et aux poursuites applicables aux infractions terroristes s’appliquent également à ces agissements.
The latter initiative — on which the Council agreed a common approach already in April 2008 — is intended to harmonise national provisions on public provocation to commit a terrorist offence, recruitment and training of terrorists, so that these forms of behaviour are punishable throughout the EU also when committed through the Internet, and to ensure that existing provisions on penalties, liability of legal persons, jurisdiction and prosecution applicable to terrorist offences apply also to such forms of behaviour.

S'agissant des sanctions, elle introduit un principe de "circonstance aggravante" en prévoyant que les "infractions terroristes" et certaines infractions liées au terrorisme doivent être passibles de peines privatives de liberté plus sévères que celles prévues par le droit national lorsqu'elle sont commises en dehors d'un contexte terroriste, elle fixe le seuil minimal des peines privatives de liberté maximales encourues à 15 ans pour la direction d'un groupe terroriste et à 8 ans pour la participation à un groupe terroriste, elle énumère un certain nombre de sanctions dont peuvent être passibles les personnes morales (En particulier des mesures d'exclusion du bénéfice d'un avantage ou d'une aide public, l'interdiction d'exercer une activité commerciale, le placement sous surveillance judiciaire, la dissolution et la fermeture d'établissement), elle prévoit un système de "repentis" en intègrant des circonstances particulières permettant aux Etats membres de réduire les peines d'emprisonnement lorsque le terroriste renonce à ses activités ou fournit certaines informations aux autorités administratives ou judiciaires.
Regarding penalties, it introduces a principle of "aggravating circumstance" by providing that "terrorist offences" and certain offences linked to terrorism must be punishable by custodial sentences heavier than those imposable under national law for such offences in the absence of a terrorist intent, it sets the minimum level of the maximum penalty at 15 years for directing a terrorist group and 8 years for participation in a terrorist group, it enumerates a series of penalties that can be imposed on bodies corporate (in particular exclusion from entitlement to public benefits or aid, temporary or permanent disqualification from the practice of commercial activities, placing under judicial supervision, judicial winding-up order and closure of establishments), it provides for a system of "repentis" by providing for specific circumstances in which Member States may reduce prison sentences where the terrorist renounces terrorist activity or provides the administrative or judicial authorities with information.
