Actuellement, il existe de grandes différences d’un État membre à un autre. Seuls six États membres disposent d’une législation spécifique concernant le terrorisme (un de ces États est le Portugal), une harmonisation s’avère donc essentielle à ce niveau, de manière à éviter que les terroristes ne puissent tirer parti de ces différences de traitement juridique entre les États ou qu’ils n’exploitent les lacunes juridiques découlant des limites géographiques des enquêtes.
There are currently considerable differences between Member States, inasmuch as only six Member States have specific legislation on terrorism (one of them being Portugal). Harmonisation is, therefore, crucial, at this level, so as to prevent terrorists being able to take advantage of these differences in the Member States’ legal processes or exploit any legal loopholes arising from the geographical limitations of investigations.
