Despite the existence of the Directive on copyright in the information society the situation in terms of the collective management of copyright and related rights for online services is extremely complex, particularly because of the territorial nature of copyright law and the absence of a pan-European licensing system.

Calls on the Commission to review the issue of cross-border management of rights and change the current situation of legal uncertainty created by Commission Recommendation 2005/737/EC of 18 October 2005 on collective cross-border management of copyrights, taking into account the fact that copyright is inherently territorial for cultural, traditional and linguistic reasons and ensuring a pan-European licensing system providing consumers with access to the widest possible choice of content and not at the expense of European local repertoire;

S'agissant de la question des droits, j'aimerais souligner qu'il n'y a aucune raison de penser que ce modèle de licence multiterritoriale est nuisible à la diversité culturelle ou aux droits des artistes, alors que c'est bénéfique pour les détenteurs des droits, qui reçoivent plus d'argent qu'avec l'ancien modèle territorial.
Regarding the issue of rights, I would like to underline that there is no reason to think that this multiterritorial licensing model is bad either for cultural diversity or for the rights of artists, while it is good for the rightholders, who get more money than under the old territorial model.

Bien que la reconnaissance mutuelle soit à la base même de la création d'un espace européen de liberté, de sécurité et de justice, l'extension des effets territoriaux des déchéances de droits pourrait être ressentie comme une aggravation de la sanction et soulever la question des droits de la personne qui verra le champ d'application territorial de la déchéance étendu à toute l'Union.
22. Although mutual recognition is the cornerstone of the establishment of a European area of freedom, security and justice, extending the territorial effect of disqualifications could be seen as aggravating the sanction and raises the issue of the rights of the individual who will see the territorial scope of the disqualification extended to the whole territory of the European Union.
