The competent authority shall ensure that the provisions of this Regulation are applied on its territory, regarding all actions carried out on its territory, and actions carried out abroad relating to instruments admitted to trading on a regulated market, for which a request for admission to trading on such market has been made, auctioned on an auction platform or which are traded on an MTF or an OTF or for which a request for admission to trading has been made on an MTF operating within its territory.

They can also take the fingerprints of aliens found illegally staying on their territory in order to check whether they have applied for asylum (on their territory or that of another Member State). They have to send these data promptly to the EURODAC Central Unit, managed by the Commission, which will register them in the Central database and compare them with already stored data. Such comparison can produce "hits", when the data introduced match with already stored data. Where hits reveal that an asylum seeker has already applied for asylum or that she/he entered the territory irregularly in another Member State, the Member States together can act in accordance with the Dublin Regulation.

En vue de vérifier si un étranger se trouvant illégalement sur son territoire n'a pas auparavant présenté une demande d'asile dans un autre État membre, chaque État membre peut transmettre à l'unité centrale les données dactyloscopiques relatives aux empreintes digitales qu'il peut avoir relevées sur un tel étranger, âgé de 14 ans au moins, ainsi que le numéro de référence attribué par cet État membre.
1. With a view to checking whether an alien found illegally present within its territory has previously lodged an application for asylum in another Member State, each Member State may transmit to the Central Unit any fingerprint data relating to fingerprints which it may have taken of any such alien of at least 14 years of age together with the reference number used by that Member State.

En ce qui concerne la question du trafic illicite de migrants, l'article 27 de la convention d'application de l'accord de Schengen oblige à '"instaurer des sanctions appropriées à l'encontre de quiconque aide ou tente d'aider, à des fins lucratives, un étranger à pénétrer ou à séjourner sur le territoire d'une Partie Contractante en violation de la législation de cette Partie Contractante relative à l'entrée et au séjour des étrangers".
As regards the issue of smuggling of migrants, Art. 27 of the Schengen Implementation Agreement requires "to impose appropriate penalties on any person who, for financial gain, assists or tries to assist an alien to enter or reside the territory of one of the Contracting Parties in breach of that Contracting Party's law on the entry and residence of aliens".
