4. Le présent règlement s’applique à tous les terrains contigus à l’aéroport ou situés dans son voisinage, y compris les emprises de voies publiques et une partie du fond du fleuve Saint-Laurent; ces terrains sont définis à la partie II de l’annexe, sauf les terrains qui font à l’occasion partie de l’aéroport.
4. These Regulations apply to all the lands adjacent to or in the vicinity of the airport, including public road allowances and land under part of the St. Lawrence River, the outer limits of which lands are described in Part II of the schedule, other than such lands as from time to time form part of the airport.

47 (1) Sous réserve des autres dispositions de la présente loi, le ministre, s’il estime qu’un arpentage, sous la direction de l’arpenteur général, s’impose à leur égard, peut faire exécuter un arpentage de tous terrains appartenant à Sa Majesté du chef du Canada, ou dont le gouvernement du Canada a le pouvoir de disposer, mais lorsque l’arpentage de ces terrains influe ou est de nature à influer sur les droits des propriétaires de terrains contigus, il est exécuté par un arpenteur qui détient un certificat, diplôme, brevet ou autre document valide et en vigueur, lui octroyant le droit d’arpenter des terres dans la province où cet arpentage a lieu.
47 (1) Subject to this Act, the Minister may, if in his opinion a survey thereof under the management of the Surveyor General is required, cause a survey to be made of any lands belonging to Her Majesty in right of Canada or of which the Government of Canada has power to dispose, but where surveys of the lands affect or are likely to affect the rights of landowners of adjoining lands, the surveys shall be made by a surveyor who holds a valid and subsisting certificate, diploma, commission or other document entitling him to survey lands in the province in which the surveys are made.

Nonobstant le paragraphe 4(2) du Règlement sur les terrains contigus à des canaux relevant du ministère des A.I. et du N.C., le ministre des Affaires indiennes et du Nord canadien peut louer à la Galeries Canada Holdings Limited et à Olympia & York Developments Limited, corps constitués en vertu des lois de la province d’Ontario, pour 42 ans, un terrain contigu au canal Rideau dans la municipalité d’Ottawa-Carleton, dans la province d’Ontario, d’une superficie d’environ 61 600 pieds carrés dont le périmètre est indiqué par un trait rouge sur le plan n 42482 du 8 novembre 1974 conservé dans les archives du ministère des Affaires indiennes et du Nord canadien.
2. The Minister of Indian Affairs and Northern Development may, notwithstanding subsection 4(2) of the I. A. and N.D. Canal Land Regulations, lease for a term of 42 years to Galeries Canada Holdings Limited and Olympia & York Developments Limited, bodies corporate, duly incorporated under the laws of the Province of Ontario, the lands on the Rideau Canal, in the Regional Municipality of Ottawa-Carleton, in the Province of Ontario, containing approximately 61,600 square feet and shown outlined in red on Plan No. 42482 dated November 8, 1974 and on file in the records of the Department of Indian Affairs and Northern Development.

The problem is with paragraph 10(2)(b), which allows the minister to enter into agreements “with a local government body having jurisdiction on lands adjacent to a park for the supply of water from the park to any place on those adjacent lands”.
