Eu égard aux dispositions de la loi no 9/2012 et à l’objet de la taxe prévue par cette loi, est-il nécessaire de considérer que l’article 110 TFUE doit être interprété en ce sens qu’il s’oppose à ce qu’un État membre de l’Union institue une taxe sur les émissions polluantes applicable à l’immatriculation des véhicules provenant d’un autre État de l’Union, taxe qui ne s’applique pas à l’immatriculation lors du transfert du droit de propriété sur les véhicules nationaux pour lesquels une telle taxe ou une taxe similaire a déjà été payée, dans les conditions où la valeur de cette taxe résiduelle incorporée dans la valeur des véhicules se trouvant sur le marché interne est inférieure à la nouvelle taxe?
In the light of Law No 9/2012 and the purpose of the tax provided for thereunder, must Article 110 TFEU be interpreted as precluding a Member State of the European Union from establishing a tax on pollutant emissions, applicable upon the registration of motor vehicles coming from another Member State of the European Union, where that tax does not apply to the registration of domestic motor vehicles, upon the transfer of ownership of such vehicles, in respect of which such a tax or a similar tax has already been paid, where the amount of such a residual tax incorporated into the value of the motor vehicles on the domestic market is lower than the new tax?

Toutefois, il découle des considérations qui précèdent que dans tous les cas — c’est-à-dire même si les considérations liées aux règles de concurrence ne sont pas prioritaires —, les aides, telles que le remboursement de la taxe considéré en l’espèce, doivent être examinées sur la base des règles de concurrence applicables en vertu du traité CE.
However, it follows from the above-mentioned considerations that in any case — i.e. even if competition-law considerations do not take priority — aid such as the present tax refund must be examined on the basis of the relevant competition rules under the EC Treaty.

Stresses that the creation of a small sales tax on each financial transaction - shares, bonds, currency and derivatives -, in the spirit of the Tobin proposal for currency markets, would penalise short-term acquisitions, reducing speculation and the volatility of financial markets; considers that this proposal with also give governments a tool to intervene directly on financial markets; stresses that this could also provide additional funding to fight tax base erosion and alleviate the tax burden on labour; recalls that an imposition of a tax of 0,5% on each financial transaction, with different levels concerning the risk of the financial instrument, could provide an amount equal to the EU budget annually; calls on Member States to coordinate efforts to create such a tax;
