TRADUCTIONS EN CONTEXTE

L'article 15, paragraphe 7, du protocole no 3 à l'accord d'association euro-méditerranéen intérimaire relatif aux échanges commerciaux et à la coopération entre la Communauté européenne, d'une part, et l'Organisation de libération de la Palestine (OLP), agissant pour le compte de l'Autorité palestinienne de la Cisjordanie et de la bande de Gaza, d'autre part (1) (ci-après dénommé «accord»), tel que modifié par la décision no 1/2009 du comité mixte UE-OLP du 24 juin 2009 (2) permet, sous certaines conditions, la ristourne ou l'exonération partielle des droits de douane ou des taxes d'effet équivalent jusqu'au 31 décembre 2009.
Article 15(7) of Protocol No 3 to the Euro-Mediterranean Interim Association Agreement on trade and cooperation between the European Community, of the one part, and the Palestine Liberation Organisation (PLO) for the benefit of the Palestinian Authority of the West Bank and the Gaza Strip, of the other part (1), (‘the Agreement’), as amended by Decision No 1/2009 of the EU-PLO Joint Committee of 24 June 2009 (2), allows drawback of, or partial exemption from, customs duties or charges with equivalent effect, subject to certain conditions, until 31 December 2009.

En vertu de l’article 82 de l’accord sur l’Espace économique européen (ci-après dénommé l’«accord EEE»), les montants relatifs à la participation annuelle des États AELE, tels qu’ils sont confirmés à la Commission par le comité mixte de l’Espace économique européen en conformité avec l’article 1er, paragraphe 5, du protocole 32 annexé à l’accord EEE, donnent lieu à l’ouverture intégrale, dès le début de l’exercice, tant des crédits d’engagement que des crédits de paiement correspondants.
2. Under Article 82 of the Agreement on the European Economic Area (hereinafter ‘EEA Agreement’) the amounts of the annual participation of the EFTA States, as confirmed to the Commission by the Joint Committee of the European Economic Area in accordance with Article 1(5) of Protocol 32 annexed to the EEA Agreement, shall give rise to the provision, at the start of the financial year, of the full amounts of the corresponding commitment appropriations and payment appropriations.

While either party may request a meeting of the Joint Committee to consider the Agreement's effects on labour, employment and working conditions, there is no explicit statement that "the opportunities created by the Agreement are not intended to undermine labour standards" nor is the Joint Committee required to consider "the social effects of the Agreement as it is implemented and [develop] appropriate responses to concerns found to be legitimate".

En effet, un tel comité mixte implique la création d'une structure organisationnelle qui dispose du pouvoir discrétionnaire de prendre des décisions contraignantes pour les parties à l'accord, notamment quant au rétablissement de cet accord et au règlement des différends (voir l'article 4, paragraphe 7, de l'accord et l'article 4 du protocole).
Bearing in mind the purpose and the substance of the proposal for a Council decision on the conclusion of the abovementioned Protocol, the Joint Committee may be regarded as a ‘specific institutional framework’, since such a committee involves the establishment of an organisational structure which has the discretionary power to take decisions which are binding on the parties to the Agreement, with particular regard to the re-establishment of the Agreement and the settlement of disputes (see Article 4(7) of the Agreement and Article 4 of the Protocol).

The question which arises is that of deciding whether the Mixed Committee should or should not be deemed to constitute ‘a specific institutional framework by organising cooperation procedures’ within the meaning of the second subparagraph of Article 300(3) of the EC Treaty, pursuant to which Parliament’s assent is required.

3. the Finnish authorities submit for the approval of the EEA Joint Committee a report before the date of entry into force of the decision by the EEA Joint Committee to include the third life assurance Directive 92/96/EEC in the EEA Agreement, stating which measures have been taken to split up TEL activities from normal insurance activities carried out by Finnish insurance companies in order to conform to all the requirements of the third life assurance Directive.
