5. 5. Where the contracting authority uses the option provided for in point (b) of paragraph 3, to formulate technical specifications in terms of performance or functional requirements, it shall not reject a tender which complies with a national standard transposing a European standard, a European technical approval, a common technical specifications, an international standard or technical reference systems established by a European standardisation body, if those specifications address the performance or functional requirements which it has laid down.

3. Technical specifications shall be formulated by reference to European standards and national standards implementing European standards , European technical approvals, European eco-labels , common technical specifications, international standards or, when these do not exist, national standards or national technical approvals, pluri-national or national eco-labels, requiring third-party certification, environmental management systems or any other technical reference adopted by European standardisation bodies, as defined in Annex XX, provided that the reference is accompanied by the words "or equivalent'.

Technical specifications shall be formulated by referring to national standards implementing European standards, European technical approvals, European eco-labelling or working environment labelling regulations, international environmental or working environment management standards, environmental, working environment and social accounting standards, common technical specifications, international standards or when these do not exist national standards or national technical approvals, or any other technical reference produced by European standardisation bodies as defined in Annex VI, provided that the reference is accompanied by the words "or equivalent".
