AD. whereas some of the committee’s work was hindered by the fact that a number of the Member States and the Council did not reply in due time (see Annex 2) and, in the end, did not forward all the documents requested or simply made courtesy replies that hardly touched upon the substance of the requests made; whereas out of 17 MNCs invited , only four agreed to appear before the committee in June and July 2015 at the first invitation; whereas a further 11 MNCs agreed to appear before the committee only after the report was voted in the TAXE Committee and after repeated invitations, such that a new extraordinary meeting had to be convened shortly before the vote in plenary (see Annex 3); whereas the Commission did not fully cooperate either and send all room documents and informal meeting notes from the Code of Conduct meetings, only offering, because of some Member States’ intransigence, a limited consultation procedure; whereas the committee’s term of office therefore had to be extended;

The Council, on the basis of a report from the Commission, shall review the provisions of Article 1 of this Directive before 30 June 2006 and shall either, acting in accordance with Article 93 of the Treaty, adopt measures on an appropriate electronic mechanism on a non-discriminatory basis for charging, declaring, collecting and allocating tax revenue on electronically supplied services with taxation in the place of consumption or, if considered necessary for practical reasons, acting unanimously on the basis of a proposal from the Commission, extend the period mentioned in Article 4.

To some delegations it is decisive that the tax will only apply above a certain level of emissions related to the EC average; NOTES the progress made in the Ad Hoc Working Party on the Commission's proposal for a carbon/energy tax, and that a decision on a fiscal instrument of this nature will need inter alia to define the base for the calculation of the tax; PLEDGES its commitment to the rapid adoption of the proposals for the SAVE directive and ALTENER programme of the Community, and URGES the European Parliament to forward its opinion on these proposals before the meeting of the Council (Energy) in June 1993; STRESSES the importance of joint efforts and effective measures on the part of industrialized countries to combat climate change and therefore AGREES that the Community will also rapidly take an initiative in the OECD framework in order to promote the use of fiscal instruments with a view to an effective and coordinated effort to reduce CO2 emissions, consistent with the Community's own strategy; that at the same time it will continue a constructive dialogue with its other trading partners, energy producers and developing countries; WELCOMES in this context the US administration's proposal for new energy taxes as an important contribution which, together with the tax initiatives of the other OECD countries in this field, helps to meet the Community's demand that the effects on competitiveness of any corresponding tax initiative by the Community be reduced; URGES the Presidency to establish a basis for a decision on a fiscal instrument with a view to accelerating the work in the Council (ECOFIN).
