IN-CONTEXT TRANSLATIONS

1. Lorsque la Commission a ouvert la procédure de retrait temporaire du bénéfice des préférences tarifaires prévues au titre du régime spécial d’encouragement en faveur du développement durable et de la bonne gouvernance (SPG+), le pays bénéficiaire du SPG + concerné lui transmet, dans un délai prévu dans l’avis de la Commission, toutes les informations nécessaires prouvant qu’il respecte les obligations résultant de ses engagements contraignants.
1. Where the Commission has initiated the procedure for the temporary withdrawal of the tariff preferences provided under the special incentive arrangement for sustainable development and good governance (GSP+), the GSP + beneficiary country concerned shall submit all necessary information providing proof of compliance with obligations resulting from its binding undertakings within a period provided in the Commission’s notice.

2. Avant l’application des préférences tarifaires prévues par le présent règlement, la Commission adopte un acte d’exécution déterminant, conformément à la procédure consultative visée à l’article 39, paragraphe 2, une liste des sections du SPG pour lesquelles les préférences tarifaires visées à l’article 7 sont suspendues en ce qui concerne un pays bénéficiaire du SPG.
2. Prior to the application of the tariff preferences provided for in this Regulation, the Commission shall adopt an implementing act establishing, in accordance with the advisory procedure referred to in Article 39(2), a list of GSP sections for which the tariff preferences referred to in Article 7 are suspended in respect of a GSP beneficiary country.

Where the Commission finds that the reasons justifying a temporary withdrawal of the tariff preferences as referred to in Article 19(1) no longer apply, it shall be empowered to adopt delegated acts, in accordance with Article 36 to amend Annexes II, III or IV, whichever is applicable, in order to reinstate the tariff preferences provided under the preferential arrangements referred to in Article 1(2).

The rules of origin, concerning the definition of the concept of originating products, the procedures and the methods of administrative cooperation related thereto, laid down in Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code , apply to tariff preferences provided for by this Regulation to ensure that the benefit of this scheme goes only to those whom the scheme is intended to benefit.
