Member States shall apply a point system for serious infringements as referred to in point (a) of Article 42(1) of Regulation (EC) No 1005/2008 and for violations of the landing obligation referred to in point (c) of Article 90(1) of this Regulation, on the basis of which the holder of a fishing licence is assigned the appropriate number of points as a result of an infringement of the rules of the common fisheries policy’.

For the Community actions financed under this Decision, Regulation (EC, Euratom) No 2988/95 and Regulation (Euratom, EC) No 2185/96 shall apply to any infringement of a provision of Community law, including infringements of a contractual obligation stipulated on the basis of the programme, resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the European Union or budgets managed by them, by an unjustified item of expenditure.

Elle revêt néanmoins un aspect particulier s'agissant de la récidive puisque certains Etats membres appliquent, pour certaines infractions le principe de la récidive spéciale: la récidive n'est alors constituée que si la deuxième infraction fait l'objet d'une qualification du même type que l'infraction qui a donné lieu à la première condamnation (exemple: deux infractions successives en matière de trafic de drogue).
But there is a specific aspect where the question of recidivism comes up since for certain offences certain Member States apply the special recidivism principle whereby there is a repeat offence only if the second conviction is for the same offence as the first (example: two successive drug-dealing offences).

[71] 1 Article 2 -"Confiscation measures: (1) Each Party shall adopt such legislative and other measures as may be necessary to enable it to confiscate instrumentalities and proceeds or property the value of which corresponds to such proceeds (2) Each Party may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, by a declaration addressed to the Secretary General of the Council of Europe, declare that paragraph 1 of this article applies only to offences or categories of offences specified in such declaration".
