Aux fins de la présente directive, on entend par «corruption active», le fait, pour quiconque, de promettre, de proposer, ou de donner, directement ou par l'intermédiaire de tiers, un avantage, de quelque nature que ce soit, à un agent public, pour lui-même ou pour un tiers, pour que cet agent public accomplisse ou s'abstienne d'accomplir un acte relevant de sa fonction ou un acte dans l'exercice de sa fonction qui porte atteinte ou est susceptible de porter atteinte aux intérêts financiers de l'Union.
For the purposes of this Directive, ‘active corruption’ means the action of a person who promises, offers or gives, directly or through an intermediary, an advantage of any kind to a public official for himself or for a third party for him to act or to refrain from acting in accordance with his duty or in the exercise of his functions in a way which damages or is likely to damage the Union's financial interests.
