En effet, à la suite de cet avis, d'où se dégage le principe selon lequel les caractéristiques essentielles du Sénat échappent au pouvoir fédéral unilatéral, le constituant a indiqué, de façon expresse, certaines exceptions à la compétence fédérale unilatérale aujourd'hui établie par l'article 44. Parmi ces exceptions figurent notamment les questions du mode de sélection des sénateurs, des pouvoirs du Sénat et de la représentation régionale, trois éléments très liés entre eux, soit dit en passant, du point de vue des questions d'équilibre et d'architecture institutionnels.
Further to this opinion that gave rise to the principle of the exclusion of the fundamental features, or essential characteristics, of the Senate from unilateral federal jurisdiction, the framers of the Constitution expressly specified certain exceptions to the federal jurisdiction under today's section 44, including the method of selecting senators, the powers of the Senate, and regional representation, incidentally, three closely interconnected elements in terms of institutional balance and architecture.
