18. compte tenu du fait qu'un parlement démocratiquement élu a le droit d'adopter des lois en conformité avec les droits fondamentaux et le respect des minorités politiques, et selon une procédure démocratique appropriée et transparente, et que les juridictions, aussi bien ordinaires que constitutionnelles, ont le devoir de garantir la compatibilité des lois avec la Constitution, souligne l'importance du principe de séparation des pouvoirs et du bon fonctionnement du système d'équilibre des pouvoirs; se déclare à cet égard préoccupé par cette redistribution des pouvoirs en matières constitutionnelles, au profit du parlement et au détriment de la Cour constitutionnelle, qui nuit au principe de séparation des pouvoirs et au bon fonctionnement du système d'équilibre des pouvoirs, lesquels sont des corollaires indissociables de l'état de droit; salue à cet égard la déclaration commune des présidents des cours constitutionnelles hongroise et roumaine, Péter Paczolay et Augustin Zegrean, le 16 mai 2013 à Eger, laquelle souligne la responsabilité particulière des juridictions constitutionnelles dans les pays gouvernés par une majorité des deux tiers;
18. Taking account of the right of a democratically elected parliament to adopt law in line with fundamental rights, with respect for political minorities, and with a democratically adequate and transparent procedure, and of the duty courts, both ordinary and constitutional, to safeguard the compatibility of the laws with the constitution, underlines the importance of the principle of separation of powers and a properly functioning system of checks and balances; is concerned in this connection about the shift of powers in constitutional matters to the advantage of the parliament and to the detriment of the Constitutional Court, which undermines severely the principle of separation of powers and a properly functioning system of checks and balances, which are key corollaries of the rule of law; welcomes in this regard the Eger joint statement of 16 May 2013 by the Presidents of the Hungarian and Romanian Constitutional Courts, Péter Paczolay and Augustin Zegrean, stressing that constitutional courts bear a special responsibility in countries ruled by a two-thirds majority;

– (ES) Mr President, I would like to thank the President-in-Office of the Council, not only for the accuracy of his answer, but also for what he has been doing, both during the Belgian Presidency and during the Spanish Presidency, with a view to resolving ‘within a reasonable time period’ – to use his own words – these two problems: that of resolving the Romanian adoption system, in order to make it compatible with international agreements and, secondly, that of resolving the problems of those families who, since the procedures were begun under the former Romanian legislation, have seen no progress.
