YEAS: 7 NAYS: 3 On Clause 6 Yvan Loubier moved, That Bill C-7, in Clause 6, be amended by replacing subsections (1) through (4) with the following “(1) An administration of government code must address and achieve the following objectives: (a) frequency of meetings; (b) the manner of calling and publicizing meetings; (c) the participation of members in meeting and; (d) the keeping of minutes of proceedings at meetings and access to the minutes by members (2) An administration of government code must address and achieve the following objectives respecting meetings of the Council of the band: (a) meetings which are to be open to members of the band and the frequency of such meetings; (b) the manner of calling and publicizing meetings; (c) the manner of making decisions and exercising the Council's powers; and (d) the keeping of records of the Council's decisions and access to those records by members of the band (3) government code must address and achieve the following objectives respecting the development, making and registration of band laws: (a) providing for reasonable notice to band members of a proposed law and permitting affected persons to comment on it before its made; (b) prescribing the procedure for making of band laws by the Council; and (c) providing for the maintenance of a band registry of codes and laws (4) An administration of government code must address and achieve the following objectives: (a) setting out the roles and authority of the band administration and its relationship to the Council; (b) providing for conflicts of interest of members of the Council and employees of the band; (c) respecting access to information under the control of the band, protection of personal information under its control and access by individuals to information about themselves; and (d) establishing a procedure for amending the code”.

(Return tabled) Question No. 62 Mr. John Cummins: With regard to the land areas and persons who reside within the area covered by the Tsawwassen Territory as set in the Tsawwassen Final Agreement: (a) what is the number of persons who currently reside in the Territory; (b) how many persons reside in the Territory and how many of these persons are under the Indian Act members of the Tsawwassen Band in (i) each of the Gulf Islands, (ii) the City of Richmond, (iii) the City of Vancouver, (iv) the Municipality of Delta, (v) the City of White Rock, (vi) the City of Surrey, (vii) the City of Burnaby, (viii) the City of New Westminster, (ix) the City of Coquitlam, (x) the City of Port Coquitlam, (xi) Langley City, (xii) the Municipality of Pitt Meadows, (xiii) the Municipality of Maple Ridge, (xiv) the Township of Langley, (xv) the Greater Vancouver Regional District Electoral Area “A”; (c) what was the population of the Tsawwassen Indian Band on an annual basis from its establishment to December 31, 2006; (d) what were the land holdings, in hectares, of the Tsawwassen Indian Band on an annual basis from its establishment as a band to December 31, 2006; (e) if the Tsawwassen Indian Band landholdings were decreased in any year, for what reason did the decrease occur and what, if any, compensation or payment was provided to the Band; and (f) what other bands, tribes or aboriginal organizations have territorial claims that overlap Tsawwassen Territory?

We are seeking to amend clause 10 by deleting lines 25 to 39 on page 8. In effect, this deletes all of subclause (3), which is the minister's authority to take punitive measures if, in the minister's opinion, it is necessary to require that remedial measures be taken in any of the following circumstances: the deterioration of a band's financial health that compromises the delivery of essential services and programs; the failure to make financial statements publicly available within the period specified under subclause 9(3) in other words, if a band fails to make their financial statements available to anyone who asks for them, or even charges more than what may be considered a reasonable fee for a copy of those forms, the minister would be justified by this clause to then take “remedial measures”; or due to the denial of an opinion, or an adverse opinion, by the band's auditor on the band's financial statements in other words, if the auditor came forward with a negative opinion of the state of the band's financial statements, the minister could then exercise his very extensive authorities and take “remedial measures”.
