La décision attaquée a été adoptée sans qu’il ne soit tenu compte des éléments de preuve et d’appréciation communiqués par les autorités italiennes durant la phase de pré-instruction, et en violation du principe maintes fois réaffirmé par la Cour de justice selon lequel la Commission et les États membres doivent coopérer loyalement afin de surmonter toutes les difficultés qui surgissent dans le cadre de l’exécution d’une décision de récupération d’une aide d’État.
The contested decision was adopted without account being taken of the evidence and assessments provided by the Italian authorities during the pre-investigation stage and was adopted in breach of the principle, repeatedly confirmed by the Court of Justice, that the Commission and the Member States have a duty to cooperate sincerely in order to overcome any difficulties which may arise during the implementation of a decision concerning the recovery of State aid.
