Les États membres font en sorte que les professionnels au sujet desquels un message d’alerte est envoyé à d’autres États membres soient informés par écrit et en temps réel des décisions relatives à cette alerte, qu’ils puissent intenter un recours en vertu du droit national contre ces décisions ou demander la rectification de ces décisions et qu’ils aient accès à des moyens d’obtenir réparation en cas de préjudice causé par une fausse alerte envoyée à d’autres États membres, auxquels cas la décision relative à l’alerte doit être qualifiée de manière à indiquer qu’elle fait l’objet d’une procédure intentée par le professionnel.
6. Member States shall provide that professionals, in respect of whom alerts are sent to other Member States, are informed in writing of decisions on alerts at the same time as the alert itself, may appeal under national law against the decision or apply for rectification of such decisions and shall have access to remedies in respect of any damage caused by false alerts sent to other Member States, and in such cases the decision on the alert shall be qualified to indicate that it is subject to proceedings by the professional.
