The first subparagraph shall apply mutatis mutandis to beneficiaries who are found not to have complied with the rules on cross-compliance, at any time during three years from 1 January of the year following the calendar year in which the first payment was granted under the support programmes for restructuring and conversion or at any time during one year from 1 January of the year following the calendar year in which the payment was granted under the support programmes for green harvesting referred to in Regulation (EU) No 1308/2013('the years concerned').

However, if the sound recording is published before the copyright expires, the copyright continues until the end of 50 years after the end of the calendar year in which the first publication of the sound recording occurs.

If the sound recording in which the performance is fixed is then published before the end of the term of copyright in the performance, copyright in the performance shall continue for 50 years following the end of the calendar year in which the sound recording was first published, but shall not extend beyond 99 years following the end of the calendar year in which the performance occurred in the first place.

Cet article modifie l’article 23 de la LDA, qui prévoit la durée du droit d’auteur sur la prestation et sur l’enregistrement sonore (droit qui expire actuellement à la fin de la 50 année suivant l’année civile de son exécution) et prolonge la durée selon les modalités suivantes.
This clause amends section 23, which sets out the term of copyright with regards to a performer’s performance and a sound recording (presently 50 years following the end of the calendar year in which the performance or sound recording was first made) and extends the term as follows.

3. Member States shall compile a report on the application of this Regulation in respect of each whole or part calendar year during which this Regulation applies, in the form laid down in Annex II. This report may be integrated into the annual report to be submitted by Member States pursuant to Article 21(1) of Council Regulation (EC) No 659/1999 , and shall be submitted by 30 June of the year following the calendar year covered by the report.
