Le règlement 925/99/CE relatif à l'immatriculation et à l'exploitation, dans la Communauté, de certains types d'avions à réaction subsoniques civils modifiés - appelé également règlement Hushkit - a également été adopté parce qu'à l'époque, l'OACI n'avait ni actualisé ses valeurs limites pour le bruit émis par les avions, ni formulé des restrictions d'exploitation claires, qui auraient permis de réduire les nuisances sonores émises par des aéronefs conformes et nouvellement immatriculés.

2". avion à réaction subsonique civil dont le certificat a été renouvelé": un avion initialement certifié selon les critères du chapitre 2 ou selon des normes équivalentes, ou initialement non certifié sur le plan acoustique puis modifié afin de répondre aux normes du chapitre 3, soit directement, par des mesures techniques, soit indirectement, par des mesures restreignant l'exploitation; les avions à réaction subsonique civils qui, initialement, n'ont pu avoir une double certification aux normes du chapitre 3 que par des restrictions de poids doivent être considérés comme des avions dont le certificat a été renouvelé; les avions à réaction subsoniques civils qui ont été modifiés afin de répondre aux normes du chapitre 3, dont les moteurs ont été entièrement remplacés par des moteurs dont le taux de dilution est égal ou supérieur à trois ne doivent pas être considérés comme des avions dont le certificat a été renouvelé;
(2) "recertificated civil subsonic jet aeroplane" shall mean a civil subsonic jet aeroplane initially certificated to Chapter 2 or equivalent standards, or initially not noise-certificated which has been modified to meet Chapter 3 standards either directly through technical measures or indirectly through operational restrictions; civil subsonic jet aeroplanes which initially could only be dual-certificated to the standards of Chapter 3 by means of weight restrictions, have to be considered as recertificated aeroplanes; civil subsonic jet aeroplanes which have been modified to meet Chapter 3 standards by being completely re-enginged with engines having a by-pass ratio of three or more are not to be considered as recertificated aeroplanes;
