Premier moyen tiré d’une erreur de droit, le Tribunal de la fonction publique (ci-après «TFP») ayant considéré, d’une part, que l’omission, par le SEAE, d’adopter des dispositions générales (ci-après «DGE») de l’article 10 de l’annexe X du statut des fonctionnaires de l’Union européenne (ci-après «statut») était justifié par le fait que le SEAE se trouvait encore, quant à l’application de cette disposition, dans une période d’adaptation et, d’autre part, que la méconnaissance de l’obligation d’adopter des DGE ne saurait être utilement invoquée par la partie requérante que si celle-ci démontre que l’AIPN a appliqué cette disposition de manière arbitraire.
First plea in law, alleging an error of law, since the Civil Service Tribunal (‘the CST’) held, first, that the failure, by the EEAS, to adopt the general provisions (‘GP’) of Article 10 of Annex X to the Staff Regulations of Officials of the European Union (‘the regulations’) was justified by the fact that the EEAS was still, as regards the application of that provision, in an adjustment period and, secondly, that the failure to fulfil the obligation to adopt the GP can be successfully invoked by the appellant only where he shows that the EEAS applied that provision arbitrarily.

Following a referendum in 2009, the then French overseas community Mayotte, located north of Madagascar in the Indian Ocean, became an overseas department of France as from 31 March 2011, and by letter of 26 October 2011, the President of France therefore asked the President of the European Council to initiate the procedure in accordance with Article 355(6) TFEU to adopt a decision amending the status of Mayotte under the EU Treaties from an overseas country or territory to an outermost region.

Il n’en demeure pas moins que, même si ce statut était adopté très rapidement, le fonctionnement pratique du système ne pourra intervenir immédiatement. De même, on ignore à combien de députés ce statut s’appliquerait dans un premier temps, car il y aura à l’évidence un certain nombre de dispositions transitoires.

Pending the adoption of the draft law amending the Central Bank of Malta Act, legislation in Malta was considered not fully compatible with Article 109 of the Treaty and the ESCB Statute as regards central bank integration into the ESCB at the time of the adoption of the euro.
