A. considérant que le parquet de Vienne a requis la levée de l'immunité d'Ewald Stadler, député au Parlement européen, afin de permettre aux autorités autrichiennes de mener l'enquête qui s'impose et d'ouvrir des poursuites à l'encontre d'Ewald Stadler;
A. whereas the Vienna Public Prosecutor’s Office has requested the waiver of the immunity of Ewald Stadler, Member of the European Parliament, in order to enable the Austrian authorities to conduct the necessary investigations and to take legal action against Ewald Stadler;

B. considérant que la levée de l'immunité d'Ewald Stadler est justifiée par des présomptions de tentative de contrainte aggravée au sens de l'article 15, de l'article 105, paragraphe 1, et de l'article 106, paragraphe 1, point 1, du code pénal autrichien, ainsi que de faux témoignage au sens de l'article 288, paragraphe 1, dudit code pénal;
B. whereas the waiver of Ewald Stadler’s immunity concerns alleged offences of attempted aggravated coercion under Sections 15, 105(1) and 106(1)(1) of the Austrian Criminal Code, and the offence of perjury under Section 288(1) of the Criminal Code;

– ayant entendu Ewald Stadler le 20 février 2013, conformément à l'article 7, paragraphe 3, de son règlement,
– having heard Ewald Stadler on 20 February 2013 in accordance with Rule 7(3) of its Rules of Procedure,

– vu la demande de levée de l'immunité d'Ewald Stadler, transmise en date du 9 juillet 2012 par le parquet de Vienne en liaison avec une procédure d'enquête, et communiquée en séance plénière le 10 septembre 2012,
– having regard to the request of 9 July 2012 from the Vienna Public Prosecutor’s Office for waiver of the immunity of Ewald Stadler in connection with an investigation procedure, as announced in the plenary sitting of 10 September 2012,
