- 2 - The approach adopted by the directive includes the following main points: - any terminal certified as conforming with the technical requirements will be authorized for marketing; - the "right of connection" to public telecommunications networks in the Community will be guaranteed for certified equipment, without the need for repeated testing and approval procedures; - the tests will be carried out and approval issued by approved laboratories and certification bodies set out in a Community list. To be on this list laboratories and bodies must meet strict criteria of competence, impartiality and independence which are harmonized at Community level; - the certificates of conformity issued under the procedure laid down by the Directive will be fully recognized in all Member State; - to assess conformity manufacturers will have the choice of two procedures, the EEC type-approval examination and the EEC declaration of conformity; - manufacturers will have the right to choose the laboratory or body that carries out the tests for conformity with the common technical specifications on their equipment. Accreditation of the laboratory of the manufacturer is possible as long as it satisfies the selection criteria; - the directive demands that the Member States should take all suitable measures to ensure that only terminals which meet the requirements set out in the directive are marketed. The Member States may take measures to disconnect any equipment which is not approved; - certified equipment will all bear an identical mark, namely, the "EC" mark, and other distinctive symbols making them readily identifiable.
