3. Trois mesures ont déjà été adoptées: en octobre 2010, la directive 2010/64/UE du Parlement européen et du Conseil relative au droit à l’interprétation et à la traduction dans le cadre des procédures pénales[2]; en mai 2012, la directive 2012/13/UE du Parlement européen et du Conseil relative au droit à l’information dans le cadre des procédures pénales[3] et, en octobre 2013, la directive 2013/48/UE du Parlement européen et du Conseil relative au droit d’accès à un avocat dans le cadre des procédures pénales et des procédures relatives au mandat d’arrêt européen, au droit d'informer un tiers dès la privation de liberté et au droit des personnes privées de liberté de communiquer avec des tiers et avec les autorités consulaires[4]. Des mesures relatives à la protection des personnes vulnérables soupçonnées ou poursuivies dans le cadre de procédures pénales sont présentées sous la forme d'un paquet législatif, comprenant la présente initiative, ainsi qu’une directive portant renforcement de certains aspects de la présomption d’innocence et du droit d’assister à son procès dans le cadre des procédures pénales, qui font partie des principes fondamentaux qui sous-tendent le droit à un procès équitable.
3. Three measures have already been adopted: a Directive 2010/64/EU of the European Parliament and of the Council on the right to interpretation and translation in criminal proceedings[2] in October 2010 and Directive 2012/13/EU of the European Parliament and of the Council on the right to information in criminal proceedings in May 2012[3], and Directive 2013/48/EU of the European Parliament and of the Council on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty in October 2013.[4] Measures on the protection of vulnerable persons suspected or accused in criminal proceedings are presented as a package with the present initiative, together with a Directive on the strengthening of certain aspects of the presumption of innocence and of the right to be present at trial in criminal proceedings, which form part of the underlying principles of the right of fair trial.

La présente proposition a fait l’objet d’un examen approfondi afin d’assurer la totale compatibilité de ses dispositions avec les droits fondamentaux qui sous-tendent les principes généraux du droit communautaire tels que prévus par la charte des droits fondamentaux de l’UE, ainsi qu’avec les obligations découlant du droit international.
This proposal was made subject of an in-depth scrutiny to make sure that its provisions are in full compatibility with fundamental rights as general principles of Community law, as provided in the EU Charter of Fundamental Rights, as well as obligations stemming from international law.

Les orientations peuvent aussi déterminer les règles applicables en vue d’une harmonisation progressive des principes qui sous-tendent la fixation des redevances appliquées aux producteurs et aux consommateurs (charge) en vertu des systèmes tarifaires nationaux, y compris la prise en compte du mécanisme de compensation entre gestionnaires de réseau de transport dans les redevances d’utilisation des réseaux nationaux et la fourniture de signaux de localisation appropriés et efficaces, conformément aux principes établis à l’article 14.
2. Guidelines may also determine appropriate rules leading to a progressive harmonisation of the underlying principles for the setting of charges applied to producers and consumers (load) under national tariff systems, including the reflection of the inter-transmission system operator compensation mechanism in national network charges and the provision of appropriate and efficient locational signals, in accordance with the principles set out in Article 14.

En vue de garantir une application uniforme de la directive 85/611/CEE, d’aider les États membres à s’accorder sur la question de savoir si une catégorie donnée d’actifs est éligible à l’investissement d’un OPCVM et d’assurer que les définitions soient interprétées d’une manière cohérente avec les principes qui sous-tendent la directive 85/611/CEE, et notamment les principes régissant la diversification et la limitation des risques, la capacité de l’OPCVM de racheter ses parts à la demande des porteurs et de calculer sa valeur d’inventaire nette chaque fois que des parts sont émises ou rachetées, il importe de renforcer la sécurité juridique à cet égard pour les autorités compétentes comme pour les acteurs du marché.
In order to ensure a uniform application of Directive 85/611/EEC, to help Member States to develop a common understanding as to whether a given asset category is eligible for a UCITS and to ensure that the definitions are understood in a manner consistent with the principles underlying Directive 85/611/EEC, such as those governing risk-diversification and limits to exposure, the ability of the UCITS to redeem its units at the request of the unit-holders and to calculate its net asset value whenever units are issued or redeemed, it is necessary to provide competent authorities and market participants with more certainty in this respect.

Les orientations déterminent aussi les règles applicables en vue d'une harmonisation progressive des principes qui sous-tendent la détermination des redevances appliquées aux producteurs et aux consommateurs (charge) en vertu des systèmes tarifaires nationaux, y compris la prise en compte du mécanisme de compensation entre GRT dans les redevances d'utilisation des réseaux nationaux et la fourniture de signaux de localisation appropriés et efficaces, conformément aux principes établis à l'article 4.

The guidelines shall also determine appropriate rules leading to a progressive harmonisation of the underlying principles for the setting of charges applied to producers and consumers (load) under national tariff systems, including the reflection of the inter-TSO compensation mechanism in national network charges and the provision of appropriate and efficient locational signals, in accordance with the principles set out in Article 4.
