Therefore, the Commission found that the merged entity would not be able to offer farmers lower prices for their animals, since farmers will continue to have sufficient alternative buyers for their animals. On competition in the downstream markets relating to the sale of fresh and processed meat, the investigation found that a number of strong competitors will remain active after the merger and that buyers will be able to readily switch to other meat providers. In particular, the Commission should be empowered to adopt rules modifying the end point in the manufacturing chain of certain derived products and establishing such an end point for certain other derived products, rules in regard to serious transmissible diseases in the presence of which the dispatch of animal by-products and derived products should not be allowed and/or the conditions allowing such a dispatch, measures changing the categorisation of animal by-products and derived products, measures regarding restrictions on the use and disposal of animal by-products and derived products, measures laying down conditions for the application of certain derogations regarding the use, collection and disposal of animal by-products and derived products and measures authorising or rejecting a particular alternative method for the use and disposal of animal by-products and derived products.

3. Plants processing animal by-products, plants for the transformation of animal by-products into biogas and compost and plants handling more than one category of animal by-products shall develop the procedure referred to in paragraph 1 in accordance with the principles of the system of hazard analysis and critical control points (HACCP).

As the scope of the Regulation is now being interpreted in such a way as to cover the treatment of all animal by-products (including manure and even milk processing and milk residues), whereas Parliament in fact only wished to include material obtained in slaughterhouses, its scope should be expressly clarified (namely applying to animal by-products obtained in slaughterhouses). The wide interpretation given to the definition of the term 'animal by-products' in Regulation (EC) No 1774/2002 (products 'not intended for human consumption') is in reality leading to treatment in accordance with the provisions of that Regulation being demanded even in the case of feed products (e.g. milk powder).

I am greatly encouraged that all three institutions are in general agreement on three key principles: the requirement that only animal by-products derived from animals fit for human consumption should be used in feed, cosmetic and pharmaceutical products; the prohibition of intra-species recycling; and the need to tighten certain provisions in order to improve the control and traceability of animal by-products.

The Commission’s proposal on the treatment of by-products of animal origin is a step in the right direction, but I agree with the rapporteur that we should strengthen the regulation by asking for strict separation, and hence visibility in the food chain, of the three categories of materials: extremely dangerous, for example contaminated by dioxins and transmissible spongiform encephalitis (TSE); carrying risk of diseases other than TSE; and produced from healthy animals.
