Le considérant suivant est inséré: " (24 bis) Afin d'adopter les dispositions nécessaires à l'application du présent règlement, il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité, en vue d'accorder au pays demandeur le régime spécial d'encouragement en faveur du développement durable et de la bonne gouvernance et de modifier l'annexe I du présent règlement en conséquence, d'adopter les modalités nécessaires à la mise en œuvre des dispositions relatives à la réduction des droits du tarif douanier commun applicables aux produits relevant de la position tarifaire 1701, à la suspension des droits du tarif douanier commun applicables aux produits relevant des positions tarifaires 1006 et 1701, à l'exigence d'un certificat d'importation pour les importations de produits relevant de la position tarifaire 1701, de retirer un pays du régime en modifiant l'annexe I et de mettre en place une période transitoire, de suspendre les régimes préférentiels prévus par le présent règlement, de retirer temporairement le bénéfice des régimes préférentiels en ce qui concerne tout ou partie des produits originaires d'un pays bénéficiaire, et de modifier l'annexe I du présent règlement.
The following recital is inserted: " (24a) In order to adopt the provisions necessary for the application of this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of granting the requesting country the special incentive arrangement for sustainable development and good governance and to amend Annex I to this Regulation accordingly, adopting detailed rules for implementing the provisions regarding the reduction of Common Customs Tariff duties on the products under tariff heading 1701, suspending Common Customs Tariff duties on the products under tariff headings 1006 and 1701, requiring import licences for imports of products under tariff heading 1701, removing a country from the arrangement by amending Annex I and to establish a transitional period, suspending the preferential arrangements provided for in this Regulation, temporarily withdrawing the preferential arrangements in respect of all or of certain products originating in a beneficiary country, and amending Annex I to this Regulation.

In accordance with the principles set out in Articles 4 and 6 and in the Annex, the competent authority shall compensate the public service operators for the net financial effect, positive or negative, on costs incurred and revenues generated in complying with the tariff obligations established through general rules in a way that prevents overcompensation and does not impose undercompensation. This shall be so notwithstanding the right of competent authorities to integrate public service obligations establishing maximum tariffs in public service contracts.
