On the expiry of 12 months from the date of its communication by the Depositary as provided for in paragraph 4 above an amendment to an annex shall become effective for those Parties which have not submitted a notification to the Depositary in accordance with the provisions of paragraph 5 above, provided that not more than one third of the Parties have submitted such a notification.

2. In the event of either Party's significant failure to comply with the provisions of this Agreement, or if a Party is of the view that such a failure may occur in the near future, either Party may temporarily suspend the application of this Agreement, pending the application of paragraph 1 above.
