IN-CONTEXT TRANSLATIONS

L'article 3 de la décision 2014/494/UE du Conseil (2) précise quelles sont les parties de l'accord à appliquer à titre provisoire, parmi lesquelles les dispositions relatives à l'établissement et au fonctionnement du sous-comité sanitaire et phytosanitaire (ci-après dénommé «sous-comité SPS»), du sous-comité douanier et du sous-comité concernant les indications géographiques (ci-après dénommé «sous-comité IG»).
Article 3 of Council Decision 2014/494/EU (2) specifies which parts of the Agreement are to be applied provisionally, including the provisions on the establishment and functioning of the Sanitary and Phytosanitary Sub-Committee (‘SPS Sub-Committee’), the Customs Sub-Committee, and the Geographical Indications Sub-Committee (‘GI Sub-Committee’).

The position to be taken on behalf of the Union within the Sanitary and Phytosanitary Sub-Committee established by Article 65 of the Agreement, as regards the adoption of the Rules of Procedure of the SPS Sub-Committee shall be based on the draft Decision of that sub-committee attached to this Decision.

En 2007, la Cour de justice de l’Union européenne a considéré que les actes juridiques de l’Union n’étaient pas opposables aux particuliers s’ils n’avaient pas été dûment publiés au Journal officiel et que leur mise à disposition en ligne ne saurait équivaloir à une publication en bonne et due forme au Journal officiel en l’absence, dans le droit de l’Union, de toute règle à cet égard. Ce règlement a été adopté pour que la publication du Journal officiel sous forme électronique constitue une publication en bonne et due forme, permettant ainsi un accès plus rapide et économique au droit de l’Union.
In 2007, a ruling of the Court of Justice of the European Union held that legal acts of the Union are not enforceable against individuals if they have not been properly published in the OJ and that making such acts available online did not equate to valid publication in the OJ in the absence of any rules in that regard in Union law. This regulation was adopted to permit the publication of the OJ in electronic form to constitute valid publication, thus making access to Union law both faster and more economical.

Thus, the administration cannot be criticised for having entered into a temporary staff contract on the basis of Article 2(b) of the Conditions of employment of other servants, having then terminated it by common agreement and replaced it by a contract within the meaning of Article 2(a) of those Conditions of employment in order to enable the staff member concerned to occupy a post included in the list of posts which the budgetary authorities have classified as temporary.
