Article 3 of Council Decision 2014/494/EU (2) specifies which parts of the Agreement are to be applied provisionally, including the provisions on the establishment and functioning of the Sanitary and Phytosanitary Sub-Committee (‘SPS Sub-Committee’), the Customs Sub-Committee, and the Geographical Indications Sub-Committee (‘GI Sub-Committee’).

Le sous-comité concernant les indications géographiques (ci-après dénommé le «sous-comité IG»), institué conformément à l'article 179 de l'accord d'association entre l'Union européenne et la Communauté européenne de l'énergie atomique et leurs États membres, d'une part, et la Géorgie, d'autre part (ci-après dénommé l'«accord»), assiste le comité d'association dans sa configuration «Commerce», telle qu'elle est prévue à l'article 408, paragraphe 4, de l'accord (ci-après dénommé «comité d'association dans sa configuration “Commerce”»), dans l'exercice de ses fonctions.

The Geographical Indications Sub-Committee (‘GI Sub-Committee’), established in accordance with Article 179 of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Georgia, of the other part (‘the Agreement’) shall assist the Association Committee in Trade configuration, as set out in Article 408(4) of the Agreement (‘the Association Committee in Trade configuration’), in the performance of its functions.

The Sanitary and Phytosanitary Sub-Committee (‘SPS Sub-Committee’), established in accordance with Article 65(1) of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Georgia, of the other (‘the Agreement’) shall assist the Association Committee in Trade configuration, as set out in Article 408(4) of the Agreement (‘the Association Committee in Trade configuration’) in the performance of its duties.

Pursuant to Article 65(2) of the Agreement, the Sanitary and Phytosanitary Sub-Committee (‘SPS Sub-Committee’) is to consider any matter relating to the implementation of Chapter 4 (Sanitary and Phytosanitary Measures) of Title IV (Trade and Trade-related Matters) of the Agreement.

Le paragraphe 1 n’empêche pas les autorités compétentes d’échanger des informations confidentielles ou de les transmettre à l’AEMF ou au Comité européen du risque systémique (ci-après dénommé “CERS”), sous réserve d’obligations en rapport avec l’information spécifique aux entreprises et les effets sur les pays tiers, comme prévu dans le règlement (UE) no 1095/2010 et le règlement (UE) no 1092/2010 du Parlement européen et du Conseil du 24 novembre 2010 relatif à la surveillance macroprudentielle du système financier dans l’Union européenne et instituant un Comité européen du risque systémique respectivement.
Paragraph 1 shall not prevent the competent authorities from exchanging confidential information or from transmitting confidential information to ESMA or the European Systemic Risk Board (hereinafter the “ESRB”), subject to constraints relating to firm-specific information and effects on third countries as provided for in Regulation (EU) No 1095/2010 and Regulation (EU) No 1092/2010 of the European Parliament and of the Council of 24 November 2010 on European Union macro-prudential oversight of the financial system and establishing a European Systemic Risk Board respectively.
