4. Lorsqu’une sous-installation a fait l’objet d’une modification significative de capacité entre le 1er janvier 2005 et le 30 juin 2011, les États membres exigent de l’exploitant qu’il communique, en plus de la capacité installée initiale de la sous-installation en question jusqu’au début de l’exploitation modifiée, déterminée conformément au paragraphe 3, la capacité ajoutée ou, le cas échéant, la capacité retirée, ainsi que la capacité installée de la sous-installation après la modification significative de capacité, déterminée sur la base de la moyenne des deux volumes de production mensuels les plus élevés durant les six premiers mois suivant le début de l’exploitation modifiée.
4. Where a sub-installation has had a significant capacity change between 1 January 2005 and 30 June 2011, Member States shall require the operator to submit in addition to the initial installed capacity of that sub-installation, determined in accordance with paragraph 3, until the start of changed operation, the added or, where applicable, the reduced capacity as well as the installed capacity of the sub-installation after having had a significant capacity change determined on the basis of the average of the 2 highest monthly production volumes within the first 6 months following the start of changed operation.

(2) Whereas of the measures to support these structural improvement arrangements with the aim of avoiding aggravation of existing overcapacity or the emergence of further overcapacity, the "old-for-new" rule has proved indispensable to balanced operation of the inland waterway market; whereas this rule also remains an essential instrument for intervention in the event of a serious disturbance on the same market, as defined in Article 1 of Directive 96/75/EC(5); whereas steps should be taken to prevent the benefits from the scrapping schemes conducted since 1990 being wiped out by new capacity coming into service as soon as the abovementioned rule ends; whereas it is therefore encessary to retain the "old-for-new" rule for a limited period of not more than four years while gradually reducing the ratios to zero to safeguard the transition and end the Community market intervention stage; whereas it is also important to maintain the "old-for-new" instrument for regulating the capacity of the Community fleets beyond these four years, but as a standby mechanism set at zero which could be reactivated only in the event of serious market disturbance of the kind referred to in Article 7 of Directive 96/75/EC;
