1. Si l’autorité responsable de la détermination le juge pertinent pour procéder à l’évaluation d’une demande de protection internationale conformément à l’article 4 de la directive 2011/95/UE, les États membres prennent, sous réserve du consentement du demandeur, les mesures nécessaires pour que le demandeur soit soumis à un examen médical portant sur des signes de persécutions ou d’atteintes graves qu’il aurait subies dans le passé.

Where the determining authority deems it relevant for the assessment of an application for international protection in accordance with Article 4 of Directive 2011/95/EU, Member States shall, subject to the applicant’s consent, arrange for a medical examination of the applicant concerning signs that might indicate past persecution or serious harm.

Le placement en rétention des demandeurs devrait respecter le principe sous-jacent selon lequel nul ne doit être placé en rétention pour le seul motif qu’il demande une protection internationale, conformément, notamment, aux obligations des États membres au regard du droit international et à l’article 31 de la convention de Genève.
The detention of applicants should be applied in accordance with the underlying principle that a person should not be held in detention for the sole reason that he or she is seeking international protection, particularly in accordance with the international legal obligations of the Member States and with Article 31 of the Geneva Convention.

Conformément au règlement (CE) no 1560/2003 de la Commission (9), les transferts vers l’État membre responsable de l’examen de la demande de protection internationale peuvent s’effectuer sur une base volontaire, sous la forme d’un départ contrôlé ou sous escorte.

3. Les États membres font en sorte que les organisations qui fournissent des conseils et des orientations aux demandeurs d’une protection internationale puissent accéder aux points de passage frontaliers, y compris aux zones de transit, et aux centres de rétention, sous réserve d'un accord avec les autorités compétentes de l’État membre.
3. Member States shall ensure that organizations providing advice and counseling to applicants for international protection have access to the border crossing points, including transit zones, and detention facilities subject to an agreement with the competent authorities of the Member State.

4. Lorsqu’un État membre délivre un permis de séjour de résident de longue durée – UE à un ressortissant d’un pays tiers auquel il a accordé la protection internationale, il inscrit la remarque suivante sous la rubrique «Remarques» du permis de séjour de résident de longue durée – UE de l’intéressé: «[nom de l’État membre] a accordé la protection internationale le [date]».
4. Where a Member State issues a long-term resident’s EU residence permit to a third-country national to whom it granted international protection, it shall enter the following remark in that long-term resident’s EU residence permit, under the heading ‘Remarks’: ‘International protection granted by [name of the Member State] on [date]’.

Une estimation ne peut s'appuyer que sur des données brutes périphériques au phénomène, comme le nombre de demandes d'entrée refusées, le nombre d'arrestations d'immigrants clandestins effectuées à la frontière ou dans le pays, le nombre de demandes de protection internationale rejetées, le nombre de demandes dans le cadre de procédures nationales de régularisation ou encore le nombre de retours exécutés sous la contrainte ou sous escorte.
An estimate of the scale of illegal migration can only be derived from existing hard data which have a link to the phenomenon such as refused entries, apprehensions of illegals at the border or in the country, rejected applications for international protection, applications for national regularisation procedures and escorted or forced returns.
