La directive 2002/19/CE du Parlement européen et du Conseil du 7 mars 2002 relative à l'accès aux réseaux de communications électroniques et aux ressources associées, ainsi qu'à leur interconnexion (directive «accès») , la directive 2002/20/CE du Parlement européen et du Conseil du 7 mars 2002 relative à l'autorisation de réseaux et de services de communications électroniques (directive «autorisation») , la directive 2002/21/CE du Parlement européen et du Conseil du 7 mars 2002 relative à un cadre réglementaire commun pour les réseaux et services de communications électroniques (directive «cadre») , la directive 2002/22/CE du Parlement européen et du Conseil du 7 mars 2002 concernant le service universel et les droits des utilisateurs au regard des réseaux et services de communications électroniques (directive «service universel») , et la directive 2002/58/CE du Parlement européen et du Conseil du 12 juillet 2002 concernant le traitement des données à caractère personnel et la protection de la vie privée dans le secteur des communications électroniques (directive «vie privée et communications électroniques») , (ci-après dénommées «cadre réglementaire de 2002 pour les communications électroniques», visaient à créer un marché intérieur des communications électroniques au sein de la Communauté tout en assurant un degré élevé de protection des consommateurs par une concurrence accrue.
Directive 2002/19/EC of the European Parliament and of the Council of 7 March 2002 on access to, and interconnection of, electronic communications networks and associated facilities (Access Directive) , Directive 2002/20/EC of the European Parliament and of the Council of 7 March 2002 on the authorisation of electronic communications networks and services (Authorisation Directive) , Directive 2002/21/EC of the European Parliament and of the Council of 7 March 2002 on a common regulatory framework for electronic communications networks and services (Framework Directive) , Directive 2002/22/EC of the European Parliament and of the Council of 7 March 2002 on universal service and users' rights relating to electronic communications networks and services (Universal Service Directive) and Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications) (hereinafter together referred to as ‘the 2002 regulatory framework for electronic communications’) aim to create an internal market for electronic communications within the Community while ensuring a high level of consumer protection through enhanced competition.

D. whereas the surveillance system depends, in particular, upon worldwide interception of satellite communications, although in areas characterised by a high volume of communications only a very small proportion of those communications are transmitted by satellite; whereas this means that the majority of communications cannot be intercepted by earth stations, but only by tapping cables and intercepting radio signals, something which - as the investigations carried out in connection with the report have shown - is possible only to a limited extent; whereas the numbers of personnel required for the final analysis of intercepted communications imposes further restrictions; whereas, therefore, the UKUSA states have access to only a very limited proportion of cable and radio communications and can analyse an even more limited proportion of those communications, and whereas, further, however extensive the resources and capabilities for the interception of communications may be, the extremely high volume of traffic makes exhaustive, detailed monitoring of all communications impossible in practice,
